2064 Improve Tenth Street1 1 1 1 1 ORDINANCE NO- 2064 Published in the Salina Daily Union July �° 1917 ) An ordinance providing for the paving, curbing, guttering and excavating of Tenth Street in the City. of Salina, Kansas, from the south. side of Prescott Avenue to the north side of Crawford Avenue, specifying the manner of construction and providing for the costs thereof and the manner of payment. WHEREAS, a petition has been presented to the Mayor and Council requesting the Mayor and Council to pave, curb, gutter and I xcavate Tenth Street in the city of Salina, Kansas, between the south side of Prescott Avenue and the north side of Crawford Aven- ue, and WHER&LS, said petition has been examined and found to contain the names of a majority of the resident owners of real property liable for taxation, Now therefore, Be it ordained by the Mayor and Councilmen of the City of Salina: Section 1. That it is necessary and hereby ordered that Tenth Street in the city of Salina, Kansas, from the south side of Prescott avenue to the north side of Crawford Avenue be paved with such material as the Mayor and Council shall hereafter select and designate. Such paving to be of such width as the Mayor and Council shall hereafter determine and shall extend to the lot line on such street at the intersections of streets and alleys. Sec. 2. It is necessary and hereby ordered that said streets, within the limits aforesaid, be curbed and guttered on both sides thereof with . cement curb and gutter, the curb thereof to be six (6 ) inches in thickness and the gutter thereof to be forty-two (42 ) inches in width from the back edge of such curbing and guttering to the paving line on said streets. The lot line edge of such curbing and guttering shall be set such distance from the center of said streets as the Mayor and Council shall hereafter determine; Provided, However, that at the intersection of streets and- alleys such curbing and guttering shall return to the lot lines of such streets. Sec. 3. All excavating, rolling and grading for the proper construction of said paving, curbing and guttering shall be done and such paving, curbing, and guttering shall be laid and construct- ed onstruct-ed on the established grade of said streets as heretofore or here- after established by the ordinances of the City of Salina. Sec. 4. City Engineer's plans and specifications and estimate of cost for the making of the improvements herein provided for, filed with the City Clerk on the 16th day of July, 1917, are hereby adopted and approved. by the Council. Sec - 5. The Mayor and Council shall hereafter by ordinance determine the kind of paving., curbing and guttering to --be placed on the above described streets, and shall let a contract for the construction of such paving, curbing and guttering to the most satisfactory and responsible bidder or' person. Sec. 6. After the passage and publication of this ordinance the Mayor and Council shall appoint three disinterested household- ers of the City who after having taken an oath to faithfully and impartially appraise all lots and pieces of ground liable to assess- ment and taxation for the cost of .said improvements, shall, within ten days after having been notified of their appointment proceed to appraise said lots and pieces of ground liable to taxation for such improvements, without regard t.o the improvements thereon., and after making said appraisement shall return the same to the Mayor and Council, and after such appraisement is returned to the Mayor and Council, the said Mayor and Council shall designate a time for holding a specialsessionthe purpose of hearing complaints and equalizing said appraisement, of which special session due notice' shall be given in the official- City paper, and at said spe- cial session, the Mayor and .Council shall, if they deem -it just and proper, alter or change such appraisement. See. 7. For the purpose of paying for such paving, curbing and guttering and excavating., the Mayor and Council are hereby directed and authorized to issue bonds of the City of Salina., in an amount not to exceed the contract price therefor, and to run for such a period of time as the Mayor and Council shall deter- mine, not to exceed however ten years., from the date of such bondq, and to be payable in equal amounts each year during the life_ofsuch bonds, together with interest not to exceed the rate of five per cenet per annum., which -bonds shall be payable at the fiscal agency of the State of Kansas,, and for the Purpose of paying the princi- pal and interest on such bonds as they severally become due, the Mayor and Council shall each year during the life of such bonds., levy an assessment against the lots and pieces of ground liable for taxation for the improvements herein provided for, in an amount sufficient to pay the principal and interest for that year; Provid- ed, taht for the purpose of, defraying the cost of paving and exca- vating the squares and areas formed by the crossing of street's and alleys as well as where the improvement is through or adjacent to City property, for which the City would be liable, the assessment I I J I I 2bPG11 shall be made against all of the taxable property of the City, and the City Clerk, shall Bert ify said asseesments, as they severally become due, to tner,,County :Clerk of Saline County, Kansas, at the same time and in the same manner as . other taxes are cert if ied, and said assessments shall, --be liable to the same panlaties as other taxes; Provided, that the Mayor and Council shall by ordinance apportion and assess the special" assessments aforesaid against the lots and pieces of ground in the taxing districts for said improve- ments which assessment and apportionment shall hold good for all the installments that are to be collected from the specific property chargeable with said improvements. Sec. 8. This ordinance shall take effect and be in full force from and after its publication once in the official City pa per.
