2055 Eminent Domain - Improve Eleventh StreetORDINANCE NO. 2055. (Published in the Salina - Da ilv -Union Ju np `-7 1) 1 An ordinance providing for the condemnation and appropriation of certain lots and pieces of ground in the city of Salina, Kansas, for the purpose of widening and extending Elm Street and Eleventh Street in said City, and providing for the appointment of appraisers therefor. Be it ordained by the Mayor and Councilmen of the city of Salina: Section 1. That it is necessary and should be and is here- by 'appropriated and condemned for the purpose of widening, and extending Elm Street and Eleventh St Peet in said City the follow- ing described lots and pieces of ground, to -wit: Beginning at the northwest corner of Lot Thirty-eight (38) on Tenth Street, Bishop's Addition to the City of Salina, Kansas; thence south fifty (50) feet to the southwest corner of said Lot Thirty -Eight (38) ; thence East along the south line of said Lot one hundred twenty-five (125) feet; thence in a northwesterly direbtion One Hundred Thirty -Four and sixty Three hundredths (134.63) feet to the place of beginning. All of said tract of land being in Bishop's Addition to the city of Salina, Kansas. Seca 2. The Mayor, 'by and with the consent of the Council, shall appoint three disinterested appraisers and householders to assess the damages caused thereby and who shall ascertain the actual value of the land so taken, eithout reference to the projected improvements, and the actual damages done to all other property thereby; for the payment of such value and damages the appraisers shall assess against the City the amount of benefit to the public generally and the remainder of such amount shall be assessed against the property within the benefit district to be created, which in their opinion, shall be especially benefited by the proposed improvements. And such appraisers shall make due report to the Mayor and Council of their proceedings. Sec. 3. This ordinance shall take effect and be in full force from and after its publication once in the official City paper. (SEAL) Attest: Passed and approved, June 21st.. 1917.
