WHEREAS., plans and specifications for certain'sewers herein- after described have been made and prepared by the City Engineer and have been approved by the Mayor and Council; and WHEREAS, bids for -the construction -of -such sewers have been advertised for by said City and are now on file with the City Clerk, therefore, Be it ordained by the Mayor and Councilmen of the City of Salina: Section, 1. That- the Mayor and Council deem it necessary and hereby order that the following described sewers be built and constructed, and the following catchbasins and manholes be built and constructed, in the city of Salina, Kansas, to -wit: 1. 350 feet of ten inch sewer on Bond Street at the price of sixty-two cents (62�) per lineal foot for the number of feet of such sewer actually built and constructed. Two manholes and traps for such sewer at the price of $32.00 each. Two catchbasins with iron top and brickwork therefor at the price of $15.00 each. - Fifth feet of ten inch pipe to manhole at the price of forty cents (40¢) per lineal foot for the amount actually used therefor. 2. 366 feet of ten inch sewer on College Avenue at the price of fifty-seven and one-half cents (572) per lineal foot for the amount actually built -and constructed. One manhole at the alley at the price of $27.50 Eighty feet of ten inch pipe of forty cents per lineal foot for the amount actually used therefor. Three catchbasins with iron top and brickwork at the price of 15.00 each. One catchbasin with brick work rebuilt and old cast iron top,used at the price of $8.00 100 feet of ten inch pipe at the price of forty cents per lineal foot for the amount actually used therefor. Three traps in -manhole at the price of $2.00 each. 3. 721 feet of ten inch sewer on College Avenue and Bishop Street at -the -'price -of fifty-four and one-half cents (542¢) per lineal foot for the amount actually built and constructed. One manhole at College Avenue and Bishop Street at the price of $22.00 One manhole with trap at Bishop Street at the price of $23.50. Four-catchbasins with iron top and brickwork at the price of $15.00 each. Four traps in manhole at the price of $2.00 each. 100 feet, of ten inch pipe at the price of fofPty cents per lineal foot for the amount actually used therefor. 4. Furnishing and fitting a cast iron manhole top with open top on Phillips Street, west of the Union Station at the price of $9.00 , 5. One manhole with two traps at the price of $30.00 Two catchbasins with brick work and iron top at a price of $15.00 each. 45 feet of ten inch pipe at a price of forty cents per lineal foot for the amount actually used therefor. 6. One manhole with trap at the price of $28.00 One catch - basin with brick work and cast iron top at a price of $15.00 43 feet of ten inch pipe at a price of forty cents per lineal foot for the amount actually used therefor. 7-. Two catchbasins with brick work and cast iron top at a price of $15.00 each. Two cats iron traps in manhole at a price of $2.00 each. 80 feet of ten inch pipe at a price of forty cents per lineal foot for the amount actually used. 8. Two catchbasins on Bishop Street between Thirteenth and Fourteenth Streets with brick work and iron top at a price of $15.00 each. Two traps in manhole at a price of 2.00 each. 9. Rebuilding brick work on three catchbasins and connect- ing with pipe already laid at a price of $24.00 1 1 1 1 10. One catchbasin on Prescott Avenue with brick work and iron top at a price of $15.00 35 feet of ten inch pipe at a price of forty cents per lineal foot for the amount actually used. Trap in manhole at a price of $2.00 11. Catchbasin at Prescott Avenue and Eleventh Street with brick work and cast iron top at a price of $15.00 20 feet of ten inch pipe at a price of forty cents per lineal foot for the amount actually used. Trap in manhole at a price of $2.00 Sec. 2. The plans and specifications of the City Engineer of said City of Salina, for the above described sewers, dated May 14th, 1917, and now on file with the City Clerk are hereby adopted and approved as and for the plans and specifications for the construction of the above described sewers and parts of sewers and such plans and specifications are hereby made a part of this ordinance as fully as if set out at length herein, and all work and improvements herein specified shall be done in strict accordiance with such plans and specifications and under the direc- tion of the City Engineer aforesaid. Sec. 3. That a contract be and is hereby let to C. Knudsen and L. C• Ahart for the building and construction of the sewers and parts of sewers hereinbefore specified at and for the prices hereinbefore specified; such prices to include and cover all labor and material necessary for the proper construction and completion of all of said sewers and parts of sewers, all of such sewers and parts of sewers in place as a part of the sewer system of the City as specified; in the said plans and specifications for the construe- onstrue-tion tionthereof. Sec. 4. Said G. Knudsen and L • C- Ahart shall execute a written contract with said City for the building and construction of said sewers and parts of sewers according to the terms of said plans and specifications and this ordinance, and shall file with the City Clerk good and sufficient bonds to said City, in such amount, not exceeding the total amount of said contract price, as the Mayor shall direct, conditioned that they will build and com- plete such, sewers according to the said plans and specifications; that they will properly refill the ditches made by them for the construction of such sewers according to the ordinances of the City; that they will fulfill the guaranty set out in the above mentioned plans and specifications; that they will hold and save harmless the City of Salina form all damage to persons or property which may arise by reason of the construction of such sewers and parts of sewers or through the carelessness or neglect of such con- tractors, their servants or employees; and that they will protect the said City from and against all liens for labor or material used and employed in the building and construction of .such sewersand parts of sewers. See. 5. The cost and expense of constructing and complet- ing such sewers and parts of sewers shall be assessed against all lots and pieces of ground contained in the city of Salina sa a sewer district, as provided by Ordinance No. 613, passed and approved December 23, 1887, and the Mayor and Council are hereby authorized to provide for the payment therefor by installments instead of levying the entire cost thereof as one special assessment at one time, and for such installments they may issue sewer -improvement bonds of the city of Salina, payable in installments of equal amounts .each year, none of which bonds, nor the installments there- of shall run longer than ten years nor bear interest exceeding five per cent per annum, and such bonds may be delivered to the eon - tractors constructing such sewers in payment. therefore, or the Mayor and Council may sell such bonds at not less than their par value and pay said contractors out of the proceeds thereof, and for the purpose of paying principal and interest on such bonds, as they severally become due, the Mayor and Council shall each year during the life of such bonds levy a tax or special assessment against all taxable real property in said City of Salina, at the assessed value thereof for general revenue purposes, in an amount sufficient to pay the principal of such bonds for that year, and the City Clerk shall certify said assessments and special taxes as they are severally made and levied as aforesaid, to the county clerk of Saline County, Kansas, at the same time and in the same manner as other taxes of said City are cert if ied. Sec. 6. The said contractors shall properly refill all exca- vations made by them in the construction of such sewers according to the plans and specifications of the city engineer aforesaid and shall properly refill such excavations if any sinking or depression appears therein within a period of one (1) year and after the accep- tance of said sewers by said City. Sec. 7. This ordinance shall take effect and be in force from and after its publication once in the Salina Daily Union. (SEAL) Attest: _ Passed and approved, June 4th, 1917. Chas. E.
