An ordinance amending Sections Two (2) and Six (6) of Ordinance
No. 1038, entitled, "An ordinance regulating the laying and
construction, establishing the permanent width, and declar-
ing the materials to be used in the construction of side-
walks in the city of Salina, Kansas, and providing a penalty
for violations thereof.".
Be it ordained by the. Mayor and Councilmen of the City of Salina:
Section 1. That Section Two (2) of Ordinance No. 1038, be
and the same is hereby amended so as to read as follows:
"Sec. 2. That in case owner or owners of such lot or lots
shall refuse or neglect to lay or construct such sidewalk within
thirty (30) days from the publication of such ordinance, or within
the time designated in such ordinance, it shall be the duty of the
committee on sidewalks to proceed to construct, or cause to be
constructed, such sidewalk in accordance with the provisions of such
ordinance, and the law regulating the construction of sidewalks.
Provided, That after the time designated in such ordinance for the
construction -of such sidewalk by the owner or owners of such lot or
lots, that then such owner or owners shall not construct or cause
to be constructed any such sidewalk without having first re ceived
written authority therefor from the committee on sidewalks."
Sec. 2. That Section Six (6) of Ordinance No. 1038 be and
the same is hereby amended so as to read as follows:.
"Sec. 6. Any person who shall put down or construct or
cause to be constructed or put down, within the City of Salina,
any sidewalk in violation of the provisions of this ordinance either
as to place, width or material, or who, after the expiration of
the time designated in the ordinance ordering such sidewalk, shall
put down or construct the same without written authority from the
committee on sidewalks shall be deemed guilty of a misdemeanor,
and upon conviction thereof shall be fined in any sum not less
than five nor more than fifty dollars; and every day said sidewalk
shall remain down shall be considered a separate offense and punish-
able accordingly, and such sidewalk may be deemed and considered
an obstruction in the street and may be removed by the City at any
time at the cost of the owner of the abutting property."
Sec. 3. That said orginal sections Two (2) and Six (6) of
Ordinance No. 1038, be and the same are hereby repealed.

Sec. 4. This ordinance.shall take effect and be in force
from and after its publication once in the official City paper.
