2036 Improve Eleventh Street8 ORDINANCE NO. 2036. _ ----- —__ — (Published in the linUnion,-May An ordinance provoding for the curbing and guttering of Eleventh Street, in the City of Salina, between the south line of South Street and the north line of Morrison Avenue, speci- fying the manner of construction, providing for the cost thereof and the manner of payment, and letting the contract therefor. WHEEEAS, a petition has been presented to the Mayor and Council, requesting said' Mayor and Council to curb and gutter Eleventh Street between the limits hereinbefore and hereinafter defined; and, WHEREAS, said petition has been examined and found to contain the names of a majority of the resident owners of real property liable to taxation and assessment for said improvements; therefore, Be it ordained by the Mayor and Councilmen of the City of Salina: Section 1. It is necessary and hereby ,ordered that said Eleventh Street, in the City of Salina, between the south line of South Street and the north line of Morrison Avenue, be curbed on both sides thereof with cement curb, and guttered on both sides thereof with cement gutter, such curb to be six (6) inches in thick- ness and such gutter to be thirty-six (36) inches in width, and the lot line edge of such curb shall be set fifteen and one-half (152) feet from and parallel with the center line of said street. Sec. 2. 'Such street shall be curbed and guttered with cement curbing and guttering, and according to the specifications of the City Engineer, adopted and approved by the Mayor and Council on the 14th day .of May, 1917, which such specifications for the im- provements herein are hereby adopted and approved as the specifi- cations for said Eleventh Street, between South Street and Morrison Avenue, and are hereby made a part of this ordinance. Sec. 3. A contract is hereby let to L. H. Lyon for the curb- ing and -guttering afsa id Eleventh Street,, at and for the following prices, to -wit: forty-five cents (45¢) per lineal foot for the lineal feet of cement curb placed on such street; forty-six cents (46¢) per lineal foot for the lineal feet of cement gutter placed on Bich street; ninety-one cents . (91�,-) per lineal foot for the lineal feet of combination curb and gutter placed on such street; and nine- ty-five cents (950 per lineal foot for the lineal feet of two-piece curb and gutter placed ori such street; which such prices are hereby found to be less than the estimated cost of such improvements as made by the City Engineer of said City and now on file with the City Clerk. The different kinds of such cement curbing and guttering shall be placed on such street in such manner and in such amounts as to each kind, as the City Engineer shall direct and according to the plans and specifications of such City Engineer for the construction of such curb and gutter. 1 1 1 r] 11 1 1 1 1 Sec. 4. After the passage and publication of this ordinanace the mayor and council shall a ppo int three disinterested appra is - ers who, after having taken an oath to faithfully and impartial- ly appraise all lots and pieces of ground Viable to assessment for the cost of said improvements, shall, within ten days after having been notified of their appointment, proceed to appraise said lots and pieces of ground according to law, and, after mak- ing said appra isement , shall return the same to the Mayor and Council at the first meeting thereof aft er -such appra isement shall have been made and completed, and after said a ppraisement is re- turned to the Mayor and Council the said Mayor and Council shall designate a time for holding a special session for the purpose of hearing complaints and equalizing said appra isement , of which special session due notice shall be given in the official e ity paper; and. at such special -session the Mayor and Council shall, if they deem it just and proper, alter or change such appraise- ment . Sec. 5. For the purpose of paying for the improvements in this ordinance specified the mayor and council are hereby authorized to issue bonds of the City of Salina, in an amount not to exceed the cost of such improvements, and to run for a period not to exceed four years and payable in equal installments each year together with interest not to exceed five per cent per an- num, which bonds shall be made payable at the fiscal agency of the State of Kansas; and for the purpose of paying principal and interest on said bonds as they severally become dua the Mayor and Council shall by ordinance apportion and assess against the lots and pieces of ground in the taxing district of such im- provements special assessments covering the cost of said improve- ments, and the apportionment therein contained shall hold good for all the installments that are to be collected from the spe- cific pe- cifis property chargeable with the cost of such improvements. Such assessment and apportionment ordinance shall contain the total amount of tax apportioned to each tract, piece and parcel of land, within the taxing district and shall state the number of annual installments in which such tax is to be collected; and thereafter the City Clerk shall annually, at the same time other taxes are to be certified, certify to the county clerk of Saline County, Kansas, a full list of all property liable for the cost of such work and improvements together with the respective amounts due on each of such tracts, pieces and pareels of land, which amount shall include the annual installments and the inter- est on all unpaid balances for one year at the rate of not to exceed five per cent per annum, and such amount so certified., shall be collected as other taxes are collected. Sec., 6. This ordinance shall take effect and be in force from and after its publication once in The Salina Icily Union. Passed and approved, May 14th, 1917. (SEAL) Attest: Cha n . E.
