2035 Improve Wilson Street9bPC m 6 1 i 1 1 1 ORDINANCE NO. 2035 (Published in the SalinaDaily -Union May Z,22 2 1917 ) An ordinance providing for the paving, curbing, guttering and exca- vating of Wilson Street in the city of Salina, Kansas, from the west line of Santa Fe Avenue to the east line of Highland Avenue; Ninth Street in -the city of Salina, Kansas, from the south line of the main line right of way of the Union Pacific Railroad Company to the north line of Otis Avenue; Otis Avenue in the city of Salina, Kansas, from the east line of Santa Fe Avenue to the west line of Ninth Street; Santaa Fe Avenue, in the city of Salina, Kansas from the north line of the main line right of way of the Union Pacific Railroad Company to the south line of Otis Avenue ; providing for the cost thereof and the manner of payment. Be it ordained by the Mayor and Councilmen of the City of Salina: Section 1. That it is necessary and hereby ordered that Wilson. Street, in the city of Salina, Kansas, from the west line of Santa Fe.Avenue to the east line of Highland Avenue; Ninth Street, in the city of Salina, Kansas, from the south line of the main line right of way of the Union Pacific Railroad Company to the north line of Otis Avenue; Otis Avenue. in the city of Salina, Kansas, from the east line of Santa Fe Avenue to the west line of Ninth Street; Avg ue_ in the city of Salina, Kansas, from the north line of the main line right of way of the Union Pacific Railroad Com - pay to the south line of Otis Avenue; be each paved with such materi- al as the mayor and council shall hereafter select and designate. Such paving shall be such widths as the mayor and council shall here- after determine and shall extend to the lot lines on such stree6s at the intersection of streets and alleys. Sec. 2. It is necessary and hereby ordered that said streets, within the limits aforesaid, be curbed and guttered on both sides thereof with cement curb and gutter, the curb part. thereof to be six (6) inches in thickness and the gutter part thereof .to be forty- two (42) inches in width from the back edge of such curbing and gut- tdring to the- paving line on said streets. The lot line edge of such curbing and guttering shall be set such distance from the center of said streets as the mayor and council shall hereafter determine; Provided, however, that at the intersection of streets and alleys such curbing and guttering shall return to the lot lines of such streets. Sec. 3. All excavating, rolling and grading for the proper construction of said paving, curbing and guttering shall be done and such paving, curbing, and guttering shall be laid and constructed on thb established grade of said streets as heretofore or hereafter established by the ordinances of the City of Salina. 284 Sec. 4. The City Engineer shall on or before the day of Maym 1917, file with the City Clerk specifications for the making of the Improvements herein provided for and shall file with the City Clerk an estimate of the cost of making such improvements. Sec. 5. The Mayor and Council shall hereafter by ordinance determine the kind of paving, curbing and guttering to be placed on the above described streets, and shall let -a contract for the con- struction of such paving, curbing and guttering to the most satis- factory and responsible bidder or person. Sec. 6. After the passage and publication of this ordinance the Mayor and Council shall appoint three disinterested household- ers of the C ity who after having taken an oath to faithfully and impartially appraise all lots and pieces of ground liable to assess- ment and taxation for the cost of said improvements, shall, within ten days after having been notified of their appointment proceed to appraise said lots and pieces of ground liable to taxation for such improvements, without regard to the improvements thereon, and after making said appraisement shall return the same to the Mayor and Council, and after such appointment is returned to the mayor and Council, the said Mayor and Council shall designate a time for holding a special session for the purpose of hearing complaints and equalizing said appraisement, of which special session due notice shall be given in the official city paper, and at said special session the Mayor and council shall, if they deem it just and prop- er alter or change such appraisement. Sec. 7. For the purpose of paying for such paving, curbing, guttering and excavating, the Mayor and Council are hereby directed and authorized to issue bonds of the City of Salina, in an amount not to exceed the contract price therefor, and to run for such a period of time as the mayor and council shall determine,- not to exceed however ten years, from the date of such bonds, and to be payable in ten equal amounts each year during the life of such bonb, together with interest not to exceed the rate of rive per cent per annum, which bonds shall be payable at the fiscal agency of the State of Kansas, and for the purpose of paying principal and inter- est on such bonds as they severally become due, the mayor and coun- cil shall each year, during the life.of such bonds, levy an assess- ment against the lots and pieces of ground liable for taxation for the improvements herein provided for, in an amount sufficient to pay the principal and interest for that year; Provided, that for the 1 1 1 1 1 2bPGIT _ 1 1 7 1 1 purpose of defraying the cost of paving and otherwise the squares and areas formed by the crossing of streets and alleys as well as where the improvement is through or adjacent to City property, for which the City would be liable, the assessment shall be made against all of the taxable property of the City, and the City Clerk shall certify said assessments, as they are severally made, to the County Clerk of Saline County, Kansas, at the same time and in the same manner as other taxes are certified, and said assessments shall be liable to the same penalties as other taxes; Provided, that the Mayor and Council shall by ordinance apportion and assess the spe- cil assessments aforesaid against the lots and pieces of ground in the taxing districts for said improvements which assessment and gpportionment shall hold good for all the installments that are to be collected from the specific property chargeable with said improve- ments. mprove- ments.
