2013 Issue Railroad Aid Bonds2bPGl 1 1 1 1 1 ORDINANCE NO 2013 - (Published in the Salina Daily Union, December 20th, 1916) An ordinance - providing -for the "issuance of ' Ten Thousand Dollars, ($10,000.00) of the bonds -of ` the city -of Salina, - Kansas , to aid The Salina Northern Railroad Company in securirig and - paying for land for right-of-way, depot grounds and terminal facilities in the City of Salina, Kansas. Be it ordained by the Mayor and Councilmen of the City of Salina: Section 1. That Whereas, on the 7th day of December, A. D. 1914s the Mayor and Council of the City of Salina, Kansas, duly passed, approved and caused to be published a certain Ordinance of said City, numbered 1804, and entitled, "An ordinance calling a Special Election in the city of Salina, for the purpose of submit- ting to the qualified electors thereof, the question whether the said City of Salina, Kansas, shall issue its bonds in the sum of Twenty Thousand (20,000.00) Dollars to aid the Salina Northern Railroad Company in securing and paying for land for right of way, depot grounds and terminal facilities, in the City. of Salina, Kansas." And, WHERE, after the passage of said Ordinance, the said Mayor and Council of said City caused notice to be given that said election as provided for in said Ordinance, should be held in said 8ity of Salina, at the usual places for holding elections on the 4th day of January, A. D. 1915, and that the polls should be opened at eight o'clock A-' M. of said day, and closed at six O'clock P. M. of said day, for the purpose of determining by the legal voters of the said City of Salina, Kansas, the acceptance or rejection of the proposal set forth in -said ordinance, And, WHEREASs on the 4th day of January, 19150 said election was duly held in said City pursuant to the said notice and proclamation aforesaid, And, WHEREAS, on the 8th day of January, 19152 the Mayor and Council of the City of Salina, Kansas, met at the Council Chamber in said City pursuant to the Statute in such case made and provided, and duly canvassed the vote cast at said election; and as such Board of Canvassers, found and determined that at the said elec- tion so held as aforesaid, it was found and determined by the returns of said election, that the proposition wasduly carried at said elec- tion, by a majority of the legal voters of said City voting at said. election, voting in favor thereof, and that at said special election, there was cast for said proposition five hundred (550) votes, and there were cast against said proposition one hundred fifty-five (155) votes; and that said proposition duly and legally carried by a majority of three hundred fifty -f ive (355) votes cast at said election, And 217 WHEREAS it was provided in the petition for said election and the ordinance and proclamation passed, approved and given in purasnace thereof , that there be submitted to the qualified voters of said City the following proposition: "Shall the City of Salina, Kansas, issue to the said The Salina Northern Railroad. Company forty (40) of the bonds of said City of the denomination of Five Hundred {500.00) Dollars, each, said bonds to be payable to bearer at the office of the Treasurer of the State of Kansas, in the City of Topeka, Kansas, thirty (30) years, after the date thereof, bearing interest at the rate of five per cent per annum, interest payable s em i -annually, for which interest coupons shall be attach -ed, payable at the office of the Treasurer of the State of Kansas, at the said City of Topeka, in the State of Kansas." Said bonds aforesaid, to be issued upon the following condi- tions namely: That when said Railroad shall have been built and constructed and in operation by lease or otherwise, from a point at or near the west and of Elm Street, in said City' of ' Salina, Kansas., to Lincoln Center, Kansas, and adequate side tracks and switching facilities built s " and constructed in said City of Salina, Kansas, then the mayor and Council of said City of Salina, Kansas, shall cause one half in number and amount of such bonds, with coupons attached as aforesaid, to be issued in the name ofsaid City of Salina, Kansas, and shall deliver the same to said railroad Company provided that said railroad shall have been built and completed and in operation by lease or otherwise as aforesaid to Lincoln Center, Kansas, on or before the 31st day of December.. A. D • 1915, and when said railroad shall have been built and constructed and in opeation by lease or otherwise from the said City of Salina, Kansas, to the city of Osborne, Kansas, then the mayor and council of said city. of Salina; Kansas, shall cause the .other one half in number and amount of such bonds, with coupons attached, as aforesaid to be issued in the name of said City of Salina, Kansas, and shall deliver the same to said Railroad Com- pany, provided, that said Railroad shall be built and completed and in operztion by lease or otherwise to the said City of Osborne, Kan- sas, on or before the 31st day of December, A. D. 1916, And, 1 1 1 1 n 2bPGN 1 1 1 1 1 0 WHEREAS, it has been shown to said Mayor and Council, and said Mayor and Council, do. hereby find, determine and deelare that the said railroad of said Railroad Company, before the 31tt day of December, 1916, was bauilt, constructed, completed and in operation from a point at or near the west end of Elm Street, in said City of Salina, Kansas, to Lincoln Center, Kansas, and -that adequate side tracks and swtiching facilities have been built and constructed in said City of Salina, Kansas, and that the railroad of said rail- road Company has now been built, constructed and in operation from the said City of Salina, Kansas, to the City of Osborne, Kansas, and -that said Rialroad Company has now in all respects fully complied with the conditions contained in said Ordinance, which was requisite and necessary, as a condition precedent for it to comply with. before the issuance of the Ten thousand (10,000.00) Dollars of bonds of the said City hereinbefore set forth. See. 2. That the Mayor and City Clerk of said City are hereby ordered and directed to cause to be prepared, executed and de-liv- ered to the said Railroad Company twenty (20) of the bonds of the said City of Salina, Kansas, of the denomination of Five Hundred (500.00) Dollars, each, with interest thereon at the rate of five per cent per annum, and dated on the 15th day of December, A. D. 1916, which bonds so to be made, executed and delivered as aforesaid, shall be of the substantial form as follows: UNITED STATES. OF AMERICA STATE OF KANSAS, COUNTY OF SALINE $500 No. CITY OF SAL I N A RAILROAD AID BOND; KNOW ALL MEN BY THESE PRESENTS , ._ That' the City of Salina, in the County of Saline and State of Kansas, for value received, hereby promises and agrees . to pay to the beared at the office of the Trea's- uerer of the State of Kansas, in the City of Topeka, Ptate of Kansas. thirty (30) years after the date hereof, the sum of FIVE HUNDRED DO1,! ARS , ($500), with interest, thereon from the date hereof until maturity, at the- rate of five per cent per annum, payable semi-annually on the fifteenth day of June, and December of each year at the office of The State Treasurer of the State of Kansas, in the City of Topeka, State of Kansas, on'presentation of the proper coupons attached as they severally become due. -This bond is redeemable at the will of the City of Salina, Saline County, Kansas; 'at' -any time after ten years from the date of its issuance, and is --one -of a series of twenty (20) bonds numbered from twenty one to forty" inclusive, 'and amounting in the aggregate to Un thousand'Dollars, ($10,000-000) issued to The Salina Northern Rail- road Company, a corporation, ortanized and exisiting and doing business 19 22 . under the laws of. the State of Kansas; pursuant to the provisions contained in Paragraphs 7049, 7050, 7051, 7052, 7053, 7054 and 622 of the General Statutes of the State of Kansas, for the year 1909. The provisions and requirements of said Acts and the conditions and requirements precednet necessary to the lawful issuance of this bond, have been in all respects fully and completely complied with and performed; -and the total indebtedness of said City, including this series of bonds, does not exceed the Constitutional or Statutory limitations. "'And it is hereby cert if led and recited that a sufficient tax to pay both interest and principal of this bond, at their respective maturities, will be levied and collected and payment thereof applied as provided by law. IN TESTIMONY WHEREOF, the said City of Salina, in Saline County, Kansas, has caused this bond to be dated as of the fifteenth day of December, ' 1916, and signed by the Mayor of said City and attested and registered by the City Clerk of said City, and duly issued in all respects as required by law at Salina, in.Saline County, Kansas.
