2005 Improve Alley (4th & 5th)1� ORDINANCE NO. 2005_ (Published in the Salina Daily union, December, 1916) An ordinance providing for the paving and excavating -of the alley between Fourth Street and Fifth Street, in the City of Salina, Kansas, from the north -line of Iron Avenue, north a distance of - Two Hundred Fifty '-(25a)- -feet, - specifying the manner of construction, providing for the -cost thereof and the manner of payment, and letting the contract therefor. . Be it ordained by the Mayor and Councilmen of the City of Salina: Section 1. That it is necessary and hereby ordered that the 1 alley between Fourth and Fifth Streets in the city of Salina,. Kansas, from the north line of Iron Avenue, north a distance of two hundred fifty (250) feet be paved with a cement concrete pavement as herein- after provided and according to the plans and specifications of the City Engineer of said City of Salina, which plans and specifications are now on file with the city clerk of said City and are hereby specially referred to and made a part of the ordinance as fully as if the same were set out at length herein. Sec . 2. That it is necessary and hereby ordered that all excavating necessary for the proper construction of such pavement be done according to said plans and specifications of said City Engin- eer, See. 3. Said pavement shall be ten (10) feet in width and shall be six (6) inches in thickness and shall be laid so as to conform to the grade of said alley as now or hereafter to be estab- lished. See. 4. The plans and specifications of the City Engineer for the making of the pavement herein provided for are hereby adopted and approved. See. 5. A contract is hereby let to L. H. Lyon, for the making of the improvements herein provided for at and for the uniform price of One and 53/100 Dollars, ($1.53) per square yard for the square ,yards of pavement actually laid and put in place on said alley and at and for the uniform price of Sixty cents (60¢) per cubic yard for the cubic yards of dirt actually excavated and removed from said. alley, which prices: are hereby found and determined to be less than, the estimated cost of such improvements as made by said City Engineer, which estimated cost is now on file with the City Clerk. See. 6. Such contract is awarded upon the express condition that all of the improvements herein provided for shall be done in strict accordance with the plans and specifications therefor, herein - before made a part hereof, and upon the further condition, among 1 1 1 2bPGH others, that the said L. x• Lyon, shall give to the City of Salina, a surety bond in the approximate sum of the cost of said improve- ments guaranteeing the proper and workmanlike construction of the same and guaranteeing that such pavement shall endure for a period of two years without . the need of repairs and in good condition, such bond to be approved by the Mayor as to sufficiency and by the City Attorney as to form. See. 7. After the passage and publication of this ordinance special session due notice shall be given in the official city paper, and at such special session the mayor and council shall,. if they deem it just and equitable, alter or change such appraise - me nt . the Mayor and Council shall appoint three disinterested house- holders of the City, who, after having taken an oath to faithfully and impartially appraise all lots and pieces of ground liable to assessment and taxation for the. cost of the improvements herein provided for, shall, within ten days after being notified of their appointment, proceed to appraise said lots and pieces of ground liable to assessment and taxation,, as -aforesaid, without regard to the buildings or improvements thereon, and after making such appraisement_shall return the same to the mayor and council at the first regular meeting thereof, and after such appraisement shall have been returned to the Mayor Council and said Mayor and Council shall appoint a time for holding a special meeting for the purpose of hearing complaints and equalizing such appraisement, of which special session due notice shall be given in the official city paper, and at such special session the mayor and council shall,. if they deem it just and equitable, alter or change such appraise - me nt . special assessments, covering the cost of such improvements, and the apportionment therein contained shall hold good for all the in- stallments thereod. Such assessment and apportionment shall.. con- tain the total amount of tax apportioned to each tract and parcel See. 8. For the purpose of paying for the work and improve- ment herein provided for the Mayor and Council are hereby author- ized and directed to issue bonds of the City of Salina, in an amount not to exceed the cost of such improvements, and to run for a period of one year, and payable in one installment, together with inter- est at such rate as the Mayor and Council shall hereafter determine, which bonds shall be made payable at the fiscal agency of the State of Kansas, and for the purpose of paying principal and interest on such bonds as they severally become due and payable the Mayor and Council shall by ordinance apportion and assess against the lots and pieces of ground in the taxing district of such improvements, special assessments, covering the cost of such improvements, and the apportionment therein contained shall hold good for all the in- stallments thereod. Such assessment and apportionment shall.. con- tain the total amount of tax apportioned to each tract and parcel 200 of ground in said taxing district and shall state the number of annual installments in which such tax shall be collected, and thereafter the City Clerk shall annually, at the same time other taxes are certified, cert ify .to the County Clerk of Saline County, Kansas, a full list of -all property liable for the cost of such work and improvement, together with the respective amounts due from each of such tracts and 'parcels of ground, which amounts shall, include the annual installments of interest on all unpaid balances for one year at such rate as 'such bonds shall --bear and such amount so cert if ied shall be collected as -other taxes are collected; Provided that the cost of improving the squares and areas formed by the crossing of streetsand alleys as well as where such improve- ment is through or •adjacent to city property for which the City would be liable,, the assessments shall be against all the taxable property of the City.
