An ordinance.providing for the paving, curbing, guttering and
excavating of Bishop' Street in the City of Salina, Kansas,
from -the west 1 ine - of Thirteenth Street to the east line of
College Avenue; providing for the cost thereof and the man-
ner of payment.
Be it ordained by the Mayor and Councilmen of the City of Salina:
Section 1. That it is necessary and hereby ordered that
Bishop street in the city of Salina, Kansas, from the west line
of Thirteenth Street to the east line of College Avenue, be paved
with such material as the Mayor and Council shall hereafter desig-
nate and select. Such paving shall be thirty (30) feet in
width, except that at the intersections of streets and alleys the
paving shall extend to the lot line on such street.
See. 2. It is necessary and hereby ordered that said Bishop
Street within the limits aforesaid, be curbed and guttered on
both sides thereof with cement curb and gutter, the curb part there-
of be six (6) inches and the gutter part theredf, to be forty -tiro
(42) inches in width from the back edge of such curb to the paving
line on such street and the lot line edge of such curbing and gut-
tering shall be set such distance as the Mayor and City Engineer
shall determine, from and parallel with the center line of said
bishop Street; -Provided, that at the intersections of streets
and alleys the curb and gutter shall return to the lot line of such
street.
Sec. 3. All excavating, rolling, grading and filling for
the proper constructing of said paving, curbing and guttering
shall be done and such paving, curbing, and guttering shall be laid
and constructed on the established grade of said Bishop Street as
heretofore or hereafter established by the ordinances of the City
of Sal ina .
flee. 4. That the specifications of the City Engineer of the

City of Salina, heretofore filed with the City Clerk of such City
for the work and improvements herein provided for, are hereby
adopted as and for the plans and:specifications for such work and
improvements. The City Engineer shall hereafter file with the
City Clerk an estimate of the cost of the work and improvement
herein provided for.
Sec. -5. The Mayor -and Council shall hereafter by ordinance
determine the kind of paving, curbing and guttering to be placed on
the above described street and shall let a contract for the con-
struction of such paving, curbing and guttering to the most satis-
factory

factory and responsible bidder or person.
Sec. 6. After the passage and publication of this ordinance
the Mayor and Council shall appoint three disinterested householders
of the City who after having taken an oath to faithfully and im-
partially appraise all lots and pieces of ground liable to assess-
ment and taxation for the cost of said improvements, shall, within
ten days after having been not,if ted of their appointment proceed to
appraise said lots and pieces of ground liable to taxation for
such improvements, without regard to the improvements thereon, and
after making said appraisement shall return the same to the Mayor
and Council, and after such appraisement is returned to the Mayor
and Council, the said Mayor and Council shall designate a time for
holding a special session for' the purpose of hearing complaints and
equalizing said appraisement, of which special session due notice
shall be given in the official City paper, and at said Special
Session the Mayor and Council shall, if they deem it just and pro-
per alter or change such appraisement.
See. 7. For the purpose of paying for such paving, curbing,
guttering and excavating, the kayor and Council are hereby directed
and authorized to issue bonds of the City of Salina, in an amount
not to exceed the contract price therefor,and to ran for such a
period of time as the Mayor and Council shall,determine, not to
exceed however ten years, from the date of such bonds, and to be
Payable in equal amountseach 'year during the life of such bonds,
together with interest not to exceed the rate cf five per cent per
annum, which bonds shall be payable at the fiscal agency of the
State of Kansas, and for the purpose of paying principal and inter-
est on such bonds as they severally become due, the Mayor and Coun-
cil shall each year, during the life of such bonds, levy an assess -
went against the lots and pieces of ground liable for taxation for
the improvements herein provided for, in an amount sufficient to
pay the principal and interest for that year; Provided, that for
the purpose of defraying the cost of paving and otherwise the squares
and areas formed by the crossing of streets and alleys as well as
where the improvement is through or adjacent to City property, for
which the City would be liable, the assessment shall be made against
all of the taxable property ofthe City, and the City Clerk shall
certify said assessment, as they severally made, to the County

Clerk of Saline County, Kansas, at the same time and in the same
manner as other taxes at -a certified, and said assessments shall
be liable to the same penalties as other taxes; Provided, that
the Mayor and Council shall by ordinance apportion and assess the
special assessments aforesaid against the lots and pieces of ground
in the taxing district for said improvements, which assessment
and apportionment shall hold good for all the installments that are
to be collected from the specific property chargeable with said
improvements.
See. 8. This ordinance shall take effect and be in force
from and after its publication once in The Salina Z'aily Union.
