2003 Levy Special Assessments- ORDINANCE NO-- 2003 - - ---
(Published in The Salina Daily Union, November 25th, 1916.
An ordinance relating to and apportioning and levying special
assessments on certain lots and pieces of ground in the City
of Salina, Kansas, to pay the cost of curbing and guttering
Elm -Street in said City from the east line of Fourth Street
to the west line of Front Street; University Place in said
City, from the west line of Baker Street to the east line of
the right-of-way of The Missouri Pacific Railway Company;
Fifth Street in said City, from the south line of Crawford
Avenue to the north line of Bond Street; Penn Avenue in said
City, from the north line of Iron Avenue to the south line of
Ash Street; Tenth Street in said City, f rom the north line of
Lincoln_ Avenue to the south line of Grand Avenue; Second
Street , in said .City from the south line of Walnut Street to
the north 1 ine of Mulberry Street; and Third Street, in said
City, from the south line of Walnut Street to the north line
of Mulberry Street; and relating to and providing for the
collection and payment of said assessments.
Be it ordained by the Mayor and Councilmen of the City of Salina:
Section 1. For the purpose of paying the cost of curbing
and guttering that part of Elm Street in the City of Salina, be-
tween the east line of Fourth Street and the west line of Front
Street; that part of University Place in the City of Salina, between
the west line of Baker Street and the east line of The Missouri
Pacific Right, -of -way; that part of Fifth Street in the City of
Salina, between the south line of Crawford Avenue and the north line
of Bond Street; that part of Penn Avenue- in the City of Salina, be-
tween the north line of Iron Avenue and the south line of Ash Street;
that part of Tenth Street in the City of Salina, between the north
line of Lincoln Avenue to the south line of Grand Avenue; that part
of Second Street in the City of. Salina, between the south line of
Walnut Street and the north line of Mulberry Street; and that part
of Third Street in the City of Salina, between the south line of
Walnut Street and the ,north line of Mulberry Street,, there are here-
by
ere-
by levied and assessed on the property liable therefor, being all
the lots and pieces of ground lying on either side of said streets,
for the distance improved, as aforesaid, to the center of the block,
on either side of said streets, according to the appraised value
of such lots and pieces of ground without regard to the buildings
or improvements thereon, special assessments covering the cost of
such work and improvements; said special assessments being based on
the special valuat ion and a ppra isment s of such lots and pieces of
ground heretofore made by three disinterested a-ppraisers appointed
by the Mayor and Council, which said appraisement is hereby referred
to and made a part of this ordinance, and the several amounts lev-
ied, apportioned and assessed against eacjg of said lots and pieces
of ground, for the purpose aforesaid, are hereby found to be and
are as follows, to -wit:,

Sec. 2. Said amounts, levied, apportioned and assessed
aforesaid, shall be due and collectible in four (4) equal install-
ments, the first becoming due with the taxes for the year 1917, and
one of said installments falling due each and every year thereafter
until all are paid, and all to be col lcet ed with interest as in
this ordinance provided; Provided, that the owner of any piece of
property liable for any of such special assessments may redeem his
property from such liabilAty by paying into the City Treasury the
entire amount chargeable against the same, as in this ordinance
designated, at any time within thirty days after the publication

of this ordinance and before the issuance of the bonds of said
City in payment of the balance of the cost of said improvements,
and his property so paid on shall not thereafter be liable for
any furhter assessment for the cost of said improvements, nor for
any part of said bonds.
Sec. 3. There is hereby further levied and assessed against
each lot and piece of ground described in this ordinance, interest,
at such rate as the Mayor and Council shall hereafter by ordinance
provide to be paid on the bonds which shall be issued for the
purpose of paying for the improvements described in Section One (1)
of this ordinance, on all of said installments herein mentioned,
from ,the date of the bonds which may be issued at the end of the
thirty days specified in the preceding section hereof, as by law
provided; to the time of the collection of the last of said install-
ments, as provided by law, which said interest shall be collected
annually at the same time and in the same manner as said install-
ments are collected; and after the taking effect of this ordinance,
it shall be the duty of the City Clerk to annually at the same time
other taxes are certified, to certify to the County Clerk of Saline
County, Kansas, a full list of all property liable to assessment
and taxation for such work and improvements, except such property
on which the special assessments aforesaid have been paid in full,
as herein provided, together with the respective amounts due on
each of such lots and pieces of ground, which amounts shall include
the annual installments of such special assessments together with
interest as above stated on all unpaid balances of such assess-
ments at the beginning of such year as aforesaid; and such amounts
so certified as herein provided shall be placed upon the tax roll
by the County Clerk of Saline County, Kansas, and collected as
other taxes are collected.
Sec. 4. This ordinance shall take effect and be in force
from and after its publication once in The Salina Daily Union.
