An ordinance providing for the construction of certain sewers in
the city of Salina, Kansas; letting the contract therefor,
and providing for the payment of the cost- of the same.
WHEREAS-, plans and specifications for certain sewers herein-
after described have been mede,and prepared by the City Engineer and
have been approved by the Mayor and Council; and -
WHEREAS, bids for the construction of such sewers have -hereto-
fore been advertised by the said City and are now on file with the
City Clerk; therefore,
Be it ordained by the Mayor and Councilmen of the City of Salina:
Section 1. That the Mayor and Council deem it necessary and
hereby order that the following described sewers be built and
constructed, and the following described manholes and catchbasins
be built and constricted thereon, at and for the following mentioned
prices;
48 feet of ten inch cast iron pipe on Fourth and Elm Streets
at and for the price of ,$2.00 per lineal foot;
322 feet of ten inch sewer on Elm Street, at and for the price
of forty-three cents (43¢) per lineal foot;
660 feet of fifteen inch sewer on Elm Street, at and for the
price of sixty-eight cents (68¢) per lineal foot;
625 feet of eighteen inch sewer on Elm Street,, at and for
the price of eighty-eight cents (880 per lineal foot;
1 manholes at the corner of Fourth Street and Elm Street at
and for the price of $23.00;
1 manhole at the corner of Third Street and Elm Street at and
for the price of $23.00;
1 manhole at the corner of Second Street and Elm Street at and
for the price of $23.00;
1 manhole at the corner of Front Street and Elm Street at and
for the price of $23.00;
1 manhole west of the bridge and Elm Street at and for the
price of $22.50;
2 Catchbasins at Fourth street, brick work and iron top, com-
plete in place except pipe at and for the price of $15.00 each;
4 Catchbasins at Third Street, at and for the price of $15.00
each;
4 Catchbasins at Second Street, at and for the price of $15.00

2 Catchbasins at Front Street at and for the price of $15.00
each,
2 Catchbasins west of the bridge at and for the price of $15.00
each;
10 inch sewer pipe from catchbasins to manholes to be built and
constructed on said Second Street at and for the price of forty
cents (40¢) -per lineal foot;

394 feet of ten inch sewer on Second Street at and for the
price. of forty-three cents (43�) per lineal foot;
1 manhole without trap on the last mentioned sewer at and for
the price of $24.00;
2 catchbasins thereon with brickwork and iron top, complete in
place except 10 inch pipe at and for the price of $15.00 each;
ten inch sewer pipe from catchbasin to manhole thereon at and
for the price of forty cents (400 per lineal foot;
500 feet of ten inch sewer in alley between Minneapolis and
Ellsworth Avenues, east of Santa Fe Avenue, at and for the price
of forty-four cents (44¢) per lineal foot;
2 manholes, without trap, thereon at and for the price of
$24.00 each;
250 feet of ten inch sewer on Baker Street at and for the
price of forty-two cents (42¢) per lineal foot;
1 manhole, without trap, thereon at, and for the price of
$22.00 ;
540 feet of ten inch sewer on Seventh Street, north of Ash
Street and alley between Santa Fe Avenue and Seventh Street at and
for the price of fifty-two cents (520 per lineal foot;
1 mantrole without trap thereon, at and for the price of
$28.00;
1 manhole with trap thereon, at and for the price of $29.50;
1 manhole, without trap, thereon, at and for the price of
$28.00;
two catchbasins thereon, with brick work and iron top complete
in place except ten inch pipe at and for the price of $15.00 each;
ten inch sewer pipe from manholes to catchbasins on said last
mentioned sewer at and for the price of forty cents (40¢) per lineal
foot;
410 feet of ten inch sewer on Des Moines Avenue at and for
the price of seventy cents (700 per -lineal foot;
Sec. 3. A contract is hereby let to C. T. Snyder for the
building and construction of the sewers, catchbasins and manholes
heretofore described at and for the' prices hereinbefore set out.
See. 4. It is hereby found. and determined that the prices
hereby agreed to be paid for each of said sewers, catchbasins and
manholes is less than the estimated cost of such sewers, catchbasins
and manholes in the estimates made by the City Engineer therefor,
and now on file with the City, Clerk.
Sec. 5. The person to whom said contract is - awarded asafore-
said., shall execute a written contract with said City for the
building of such sewers, catchbasins and manholes, as aforesaid,
and shall file with the City Clerk a good and sufficient bond in
the , total sum of said cont Tact, conditioned that he will build such
.sewers according to said specifications; that he will refill the
ditches made in the streets and alleys under which such sewers shall
be laid and constructed; that he will fulfill and guarantee required
in said specifications; and that he will hold and save harmless the
City of Salina from all damage to persons and property which may
arise through the carelessness or neglect of said contractor or his
servants and employees; and that he will protect said City from all
liens or claims for labor and -material used and employed in the
building of such sewers.
Sec. 6. The cost and expense of constructing such sewers
shall be assessed against all lots and pieces of ground contained
in the City of Salina as a sewer district, as provided by Ordinance
No.. 613, passed and approved Desember 23, 1887, and the Mayor and
Council are hereby authorized. to provide for the payment of the
cost thereof by installments instead of levying the entire tax or
special assessments at one time, and for such installments they may
issue Sewer Improvement Bonds of the City of Salina payable in
installments of equal amounts each year, none of which bonds nor
the installments thereof shall run longer than ten years or bear
interest exceeding five per cent per annum, and suxh bonds may be
delivered to, the contractor building such sewers in payment there-
of or the Mayor and Council may sell said bonds at not less than
their par value and pay said contractor out of the proceeds there-
of, and for the purpose of paying principal and interest on said
bonds as they severally become due, the Mayor and Council shall
each year duting the life of said bonds levy an assessment or spedial
tax against all taxable real estate in said City at the assessed

value thereof farr;gera. rev:nue purposes, in an amount suff i-
cient to pay the principal and interest of said bonds for that
year; and the City Cle14k shall certify said assessments and spe-
cial taxes as they are severally made and levied as aforesaid, to
the County Clerk of Saline County, Kansas, at the same time and

excavations made in the construction of the above described sewers
according to the plans and specifications of the City Engineer,
therefor, and shall propdrly re -fill said excavations if any
sinking or depression appears therein within a period of one (1)
year, after the acceptance of said sewers by the aforesaid City.
Sec. 8. This ordinance shall take effect and be in force
from and after its publication once in The Salina Daily Union.
