ORDINANCE NO 19 91

An ordinance providing for the curbing and guttering of Seventh
Street, in the city of Salina, Kansas, between the north
line of Elm Street and the south -line of -Pine Street, spe-
cifying the mariner of construction, providing for the cost
thereof and the manner of payment..
WHEREAS, a petition has been presented to the.Mayor and
Council requesting said Mayor and Council to curb and gutter
Seventh Street between the limits hereinbefore and hereinafter
specified; and,
WHEREAS, said petition has been examined by said Mayor and
Council and found to contain the names of a majority of the resi-
dent owners of real property -liable to taxation for such improve-
ments; therefore,
Be it -ordained by the Mayor, and Councilmen of the City of Salina:
Section 1. That it is necessary and hereby ordered that
Seventh Street, in the City of Salina, between the north line of
Elm Street and the south line of Pine Street, be curbed and guttered
on both sides thereof with cement curbing and guttering, according
to the plans and specifications of°the City Engineer of said
City hereinafter provided for, the curb part thereof to be six
(6) inches in thickness and the gutter part thereof to be forty-
two (42) inches, more. or less, from the back edge of such curb
to the paving line of said street, and' the lot line edges of
such curbing to be 'set such a distance from the center line of
said street as the Mayor and Council may hereafter determine.
Sec. 2, For the work and improvement herein provided, the
City Engineer shall make and file with the City Clerk of said City
on or before the 1st day of December, 1916, plans and specifications

gutter of the dimensions, substantially, as hereinbefore described,
and, on or before said last named date, said City Engineer shall
.file with the said Clerk an estimate cf the cost of such curbing
and guttering; Provided that at the intersections of streets and
alleys said curb and gutter shall return to the lot line on said
Seventh Street.
See. 3. That after such plans and specifications shall have
been filed with said Clerk as aforesaid, the mayor and council shall
determine the dictance such curb and gutter shall be set from the
center line of said street, and may then advertise for bids for
the construction of such improvements, and may, after the receipt
of such bids let the contract for such improvements to the most
satisfactory and responsible bidder as determined by said mayor and
Council; or said Mayor and Council may reject any and all bids for
the making of such improvements.

Sec. 4. After the passage and publication of this ordinance
the mayor and council shall appoint three disinterested householders,
who, after having taken an oth to faithfully and impartially ap-
praise all lots and pieces of ground liable to taxation and assess-
ment for the cost of the improvements herein provided for, shall,
within ten days after having, been notified of their appointment,
proceed to appraise said lots and pieces of ground liable to assess-
ment and taxation, as aforesaid, without regard to the buildings or
improvements thereon, and after making said appraisement shall re-
turn the same to the mayor and council at the first meeting thereof
after such appraisement shall have been completed, and after said
appraisement is returned to the mayor and council the said mayor
and council shall designate a time for holding a special session
for the purpose of hearing complaints and equalizing said appraise-
ment, of which special session due notice shall be given in the
official city paper; and at said special session the mayor and
council shall, if they deem it just and proper, alter or change
such appraisement.
See, 5. For the purpose of paying for the work and improve-
ments herein provided the mayor and council are hereby authorized
and directed to issue bonds of the City of $alina, in an amount
not to exceed the cost of such improvements, and to run for such
a period of time as the mayor and council shall hereafter determine,
not exceeding however ten years, together with interest at such
rate as .the mayor and council shall hereafter determine, not to
exceed however five per cent (5%) per annum, which bonds shall be-
made
emade payable at the fiscal agency of the State of Kansas, and for
the purpose of paying principal and interest on such bonds as they
severally become daze and payable the mayor and council shall by
ordinance apportion and assess against the. lots and pieces of
ground in the taxing district of said improvements special assess-
ments covering the cost of such improvements, a nd such apportion-
ment therein contained shall haold good for all the installments
that are to be collected from the specific property chargeable for
the cost of said -improvement. Such assessment and apportionment
ordinance. shall contain the total amount of the tax apportioned each
tract, piece and parcel of ground, within .said taxing district,
and shall state the number of annual installments in which such
tax is to be collected, and thereafter the City Clerk shall annual-
ly at the same time other taxes are certified, certify to the County

Clerk of Saline County, Kansas, a full list of all property liable
for the cost of such improvements, together with the respective
amounts due upon each of such tracts and parcels of ground, which
amounts shall include the annual installments and the interest for
one year on all unpaid balances at such rate as said above mention-
ed bonds shall bear, and such amounts so certified shall be col-
lected as other taxes are collected; Provided, that for the pur-
pose of defraying the cost of improving the squares and areas
formed by the crossing of streets and alleys as well as where the
improvement is through or adjacent to City property, for which
the City would be liable, the assessments shall be made against
all taxable property of the City.
Sec. This ordinance shall take effect and be in froce from
and after its publication once in The Salina Daily Union.
