ORDINANCE N0. 1987

An ordinance letting the contract for the curbing and guttering of
Twelfth Street from the north line of Bishop Street to the
south line of North Street; Phillips• Street from the south
line of the right of way of The Union Pacific Adiltoad Coppany
to the south line of the Missouri Pacific Right of may; and
University Place, from the west .line of Baker Street to the
east- line of the right of way of The Missouri Pacific Rail-
way Company in the city of Salina, Kansas.
Be it ordained by the Mayor and Councilmen of the City of Salina:
Section 1. That a contract is horeby awarded to L. H. Lyon
for the curbing and guttering of Twelfth Street in the city of
Salina, Kansas, from the north line of Bishop Street to the south
line of North Street; Phillips Sheet in the city of Salina, Kan-
sas from the south line of the right of way of The Union Pacific
Railroad Company to the south line of the right of way of The Mis-
souri Pacific Railway Company; and University Place in the city of
Salina, Kansas from the west line of Baker Street to the . east line
of the right of way of The Missouri Pacific Railway Company, at
and for the uniform price of forty-five cents (45¢) per lineal foot
for the lineal feet of cement curb placed on such streets; forty-
six cents (44) per lineal foot for the lineal feet of cement
gutter placed on such streets; eighty-five cents (85¢) per lineal
foot for, the lineal feet of combination curb and gutter placed on
such streets; and ninety cents (90¢) per lineal foot for the linml
feet of two-piece curb and gutter placed on such streets; the dif-
ferent kinds of such cement curbing and guttering shall be placed
on such streets in such manner and in such amounts, as to each kind,
as the City Engineer shall direct and according to the plans and
specifications of such City Engineer for the construction of such
curb and gutter.
Sec. 2. Such contract is awarded upon the express condition
that the work and improvements to be performed thereunder shall be
done, instrict accordance with the plans and specifications of the
City Engineer for the construction of such work and improvements
and in accordance with Ordinances Nos. 1960 and 1973, and that all
of such work shall be done in a proper and workmanlike manner, and
.upon the further condition that the said L. H. Lyon shall give to
the city of Salina a surety bond in the approximate sum of the cost
of such improvements, guaranteeing such curbing and guttering a-
gainst all defects for a period of twe (2) years, such bond to,be
approved as to sufficiency by the Mayor and as to form by the
City Attorney.

Sec. 3. The curbing and guttering on Twelfth Street from the
north line of Bishop Street to the south line of North Street shall
be so set that the lot line edges of such curbing shall be from
twenty and one-half (202) to.forty and one-half (402) featfrom
and parallel with the center line of such street;
On Phillips Street from the south line of the right - of way of
The Union 'Pacific Railway Company to the south line of the right of
way of the Missouri Pacific Railway Company, such curbing and gutter-
ing shall be so constructed that the lot line edges of such curb shall
be nineteen (19) feet from and parallel with the center line of such
street;
And on University Place, from the west line of Baker Street to
the east line of the right of way of The Missouri Pacific Railway
Company such curbing and guttering shall be so constructed that the
lot line edges of such curb shall be nineteen (19) feet from and
parallel with the center line of such street.
Sec. 4. All excavating and filling necessary for the proper
construction of such curbing and guttering shall be done by said
L. H. Lyon, and all of such improvements shall be done in conformity
to and compliance with the plans and specifications of the City
Engineer for the construction of such improvements, which plans and
specifications are hereby made a part of this ordinance as fully
as if set out at length herein.
Sec. 5. This ordinance shall take effect and be in force from
and after its publication once in The Salina Daily Union.
