1986 Improve College Avenue148 ORD INANCE NO . 1986 )ublished in the Salina Daily Union September 23rd. An ordinance providing for the curbing and guttering of College Avenue -in the city of Salina, Kansas, from the north line of Park Street to the south line of Bishop Street; and Prescott Avenue in the city of Salina, Kansas, from the west line of Ninth Street to the east line of Eleventh Street, specifying the manner of construction, providing for the cost thereof and the manner of payment. Be it ordained by the Mayor and Councilmen of the City of Salina: Section 1. , It is necessary and hereby ordered that College Avenue in the city of Salina, Kansas, from the north line of Park Street to the -south line of Bishop Street; and Prescott Avenue in the city of Salina, Kansas, from the west line of Ninth Street to the east line of Eleventh Street be curbed and guttered on both sides thereof with cement curb and gutter according to the plans and specifications of the City Engineer herein provided for. Sec. 2. Said curb and gutter shall be placed such distance from the center lines of such streets as shall hereafter be detremined by the Mayor and Council, except that the intersection of streets and alleys said curb and gutter shall return to the property line on such streets. Sec. 30 The City Engineer shall prepare and file with the City Clerk on or before the first day of December, 19162 estimates of the cost of making such improvements, and after the filing of such estimates the Mayor and Council may advertise for bids for the making of such improvements or they may let a contract , for the mak- ing of such improvements to the most satisfactory party or company without advertising for or receiving bids. Sec. 4. After the passage and publication of this ordinance the mayor and council shall appoint, three disinterested householders who, after having taken an oath to faithfully and impartially appraise all lots and pieces of ground liable to assessment and taxation for the making of such improvements herein provided for., shall, within ten days after having been notified of their appointment, proceed to appraise said lots and pieces of ground liable - to assessment and taxation,. as aforesaid, without regard to the building and Improve- ments thereon, and after making such appraisements they shall return the same to the mayor and council -at the first regular meeting thereof, after the completion of such appraisement, and after such appraisement has been returned to the mayor and council they shall designate a time for holding a special session for the purpose of hearing complaints and equalizing such appraisement , of which meeting due notice shall be given in the off is ial city paper. 1 1 1 1 1 bPGII City Clerk. For the purpose of paying for the work 'and improve- ments herein provided for the . mayor and council are hereby author- ized and directed to. issue bonds of the City of Salina., in an amount not to exceed the cost • of , such improvements, and to run for such a period of time as the mayor and council shall _hereafter detremine, not exceeding however ten years, together with interest at such rate as the mayor and council shall hereafter determine, not to exceed however five per cent (5%) per annum, which bonds shall be made payable at the fiscal agency of the State of Kansas, and for the purpose of paying principal and interest on such bonds. as they severally become due and payable the mayor and council shall by ordinance apportion and assess against the lots and pieces of ground in the taxing district of said improvements special assess- ments coverning the cost of such improvements, and such apportionment therein contained shall hodl good for all the "installments that are to be collected from the specific property chargeable for the cost of said improvements. Such assessment and apportionment ordinance shall contain the total amount of the tax apportioned each tract, piece and parcel of ground within the taxing districts and shall state the number of annual installments in which such tax is to be collected, and thereafter the City Clerk shall annually at the same time other taxes are certified, certify to the County Clerk. of Salina, County, Kansas, a full list of all property liable for the cost of such improvements, together with the respective amounts due upon each of such tracts and parcels of ground, which amounts shall include the annual installments and the interest for one year on all unpaid balances at such rate as said above mentioned bonds shall bear, and such amounts so certified shall be collected as other taxes are collected; Provided, that for the purpose of defraying the cost of paving and improving the squares and areas formed by the crossing of streets and alleys as well as where the improvement is through or adjacent to City property, for which the City would be liable, the assessments shall be made against all taxable property of the City.
