An ordinance- providing_ for the construction of certain sewers in the
city of Salina, Kansas, letting the contract therefor and pro-
viding for the payment of the cost thereof. .
WHEREAS, plans and specifications have been prepared by the
City Engineer and approved by the Mayor and Council, for the making
of the following described sewers, and
WE&LEAS, bids for the construction of such sewers have been
advertised for and received and are now on file with the City Clerk;
therefore.,
Be it ordained by the Mayor and Councilmen of the City of Salina:
Section 1. That the mayor and Council deem it necessary and
hereby order that the following described sewers shall be built and
constructed: and the following catchbasins and manholes be built and
constructed, to -wit:
A ten (10) inch sewer, on Tenth Street in said City from the south
side of Lincoln Avenue to the'north side of Grand Avenue and on such
sewer to be located three (3) manholes .
Sec-. 2. The plans and specifications of the City Engineer
for the making of such sewer are hereby adopted and approved as and
for the plans and specifications for -the making of such improvements
and are hereby made a part of this ordinance, and all.of the work
herein specified and provided for shall be done in strict accordance
with such plans and specifications and under the direction of the
City Engineer or his duly authorized assistants.
Sec. 3. A contract is hereby let to C. T. Snyder for the mak-
ing of all of the improvements herein provided for at the following
price or prices, to -wit:
For the ten inch sewer to be built and constructed on Tenth
Street from Lincoln Avenue to Grand Avenue forty-four cents (44¢)
per lineal foot for the lineal feet of such sewer actually laid and
put in place.
For three manholes on such sewer herein and in such plans and
specifications provided for the sum of $24.00
Sec. 4. The person to whom such contract is awarded as afore-
said shall execute a written contract with said City of Salina for
the building of such sewers and manholes, in such terms as said City
shall determine, and shall file with the city clerk of said City good
and sufficient bonds in the approximate sum of such improvements, con-
ditioned
on-ditToned that he will build such sewers and manholes in strict accord-
ance with said plans and specifications, and in strict accordinance

with this ordinance and said contract above provided for; that he
will re -fill the ditches made in the streets and alleys under which
such sewer shall be constructed; that he will fulfill the guaranty
required in said specifications; and that he will hold and save
harmless the City of Salina from all damages resultd.ng to the City
of Salina br:,resulting to person or property through the careless-
ness or neglect of the said contractor his agents or servants; and
that he will protect the said City from all liens or claims for la-
bor and material used and employed in the construction of such
sewer and manholes.
Sec. 5. The cost and expense of constructing such sewer
and manholes shall be assessed against all lots and pieces of
ground contained in the city of Salina as a sewer district, as
provided by Ordinance No. 613, passed and approved December 23,
1887, and the Mayor and Council are hereby authorized to provide
for the cost of the construction thereof by installments instead of
levying the entire amount at one time, and for such installments
they may issue sewer improvement bonds of the City of Salina, paya-
ble in installments of equal installments in each year, none of
which bonds nor the installments shall run longer than ten years
or bear interest to exceed the rate of five per cent per annum,
and such bonds may be delivered to the contractor building such
sewers 'in payment thereof, or the mayor and council may sell such
bonds at not less than their par value and out of the proceeds
thereof pay said contractor, and for the purpose of paying princi-
pal and interest on said bonds, as they severally become due the
Mayor and Council shall each year during the life of such bonds levy
an assessment or special tax against all taxable real property in
said City of Salina, at the assessed value thereof for general re-
venue purposes, in an amount sufficient to pay the principal and
interest on said bonds for that year; and the City Clerk shall certi-
fy said assessments and special assessments, as they are severally
made and levied as aforesaid, to the county clerk of Saline County,
Kansas, at the same time and in the same manner as other City tax-
es are certified.

Sec. 6. '2he said contractor shall properly re -fill all
excavations made in the construction of said sewer and manholes
according to said plans and specifications for the making thereof,
and shall ppoperly re -fill such filled excavations if any sinking
or depressions appear, therein within a period of one year from
the completion and acceptance of such sewer by the City Council.
Sec. 7. This ordinance shall take effect and be in force
from and after its publication once in The Salina Daily Union.
