ORDINANCE Na..- 1972. _

An ordinance providing for the paving and excavating of College
Avenue from the north line of Park Street. to the south line
of Bishop Street'; Prescott Avenue from the -west line of Ninth
Street- to the east line of Eleventh Street.; .and Bond Street
from the west line of Santa Fe Avenue to the east line of
Highland AVemie, providing for the cost thereof and the
manner of payment.
Be it --ordained by the Mayor and Councilmen of the City of Salina:
Section 1. It is necessary and hereby ordered that the
following described streets in the city of Salina, Kansas, be paved
and excavated within the limits hereinafter defined:
College Avenue from the north line of Park Street to the south
line of Bishop Street;
Prescott Avenue from the west line of Ninth Street to the
east line of Eleventh Street;
Bond Street from the west line of Santa Fe Avenue to the east
line of H i ghl and . Avenue.
Sec. 2. All of such streets shall be paved such widths as
shall hereafter be detremined by the mayor and council except that.
- at the intereeetion of streets and alleys such paving shall return
to the property line on such streets.
Sec 3. The City Engineer shall prepare and file with the
City Clerk on or before the 21st day of Augusts 1916, estimates of
the cost of making such improvements, and after the filing of such
estimates the mayor and council may advertise for bids for the making
of such improvements or they may let a contract for the making of
such improvements to the lost satisfactory part or company without
advertising for or receiving bids.
Sec. 4. After the passage and publication of. this .ordinance
the mayor and council shall appoint three -disinterested householders
who, after having taken an oath to faithfully and impartially ap-
praise all lots and pieces of ground liable to assessment and taxa-
tion for the making of such improvements herein provided for, shall,
within ten days after having been notified of their appointment,
proceed to appraise said lots and pieces of ground liable to assess-
ment and taxation, as aforesaid, without regard to the buildings
or improvements thereon, and after the making of such appraisement
they shall return the same to the mayor and council at the first
regular meeting thereof after the completion of such appraisement,
and after such appraisement has been returned to the mayor and coun-
cil they shall designate a time for holding a special session for
the purpose of hearing complaints and equalizing such-appraisement,
of which meeting due notice shall be given in the official city
paper.

Sec -5. For the purpose of paying for the work and improve-
ment herein provided for the mayor and council are hereby authorized
and directed to issue bonds of the City of Salina, in an amount not
to .exceed the cost of such improvements, and to run for such a period
of time as the mayor and council shall hereafter determine, not
exceeding however ten years, together with interest at such rate as
the mayor and council shall hereafter detremine, not to exceed
however five per cent per annum, which bonds shall be made payable
at the fiscal agency of the State of Kansas, and for the purpose of
paying principal and interest on such bonds as they severally become
due and payable the mayor and council shall by ordinance apportion
and assess against the lots and pieces of ground in the taxing
districts of said improvements special assessments covering the cost
of such improvements and such apportionment therein contained shall
hold good for all the installments that ate to be collected from
the specific property chargeable for the cost Of said improvements.
Such assessment and apportionment ordinances shall contain the
total amount of the tax apportioned each tract, piece and parcel of
ground within said taxing districts and shall state the number of
annual installments in which such tax is to be collected; and there-
after the city clerk shall annually at the same time other taxes are
certified, certify to the county clerk of Saline County, Kansas, a
full list of all property liable for the cost of such improvements,
together with the respective amounts due upon each of such tracts
and parcels of ground, which amounts shall include the annual
installments and the interest for one year on all unpaid balances
at such rate as said above mentioned bonds shall bear, and such
amounts so certified shall be collected as other taxes are collected;
Provided that for the purpose of defraying the cost of paving and
improving the squares and areas formed by the crossing of streets
and alleys as well as where the improvement is through or adjacent to
city property, for which the city would be liable, the assessments
shall be made against all taxable property of the City.
Sec. 6. This ordinance shall take effect and be in force
from and after its publication once in The Salina Daily Union.
