1970 Improve Santa Fe2bPGH. 1 1 1 1 1 ORDINANCE NO, 1970 (Published in the Salina Baily Union- July—---- 1916 An ordinance providing for the paving and guttering of Santa Fe Avenue in the city of Salina, Kansas, from the south line of- Walnut Street to the north line of North -Street; provid- ing for the cost thereof and the manner of payment. WHEREAS, by resolution duly adopted by the mayor and -council on the 5th day of June, 1916, such mayor and council declared it necessary to pave and gutter the above named street within the 1 im it s above defined; and WHEREAS, said resolution was published for five consecutive days in the Salina Daily Union, a daily newspaper published in the city of Salina, Kansas; and, WHEREAS, a majority of the resident property owners liable to assessment for the cost of such improvements did not within twenty days after the last publ icat ion of such resolution file with the city clerk their protest against the making of such improvements; therefore, Be it ordained by the Mayor and Councilmen of the City of Salina: Section 1. That it is necessary and hereby ordered that Santa Fe Avenue in the city of Salina, Kansas, from the south line of Walnut Street to the north line of North Street be paved and guttered according to the plans and specifications of the city engineer of said city for the making of such improvements, which plans and specifications shall be made and filed with the city clerk on or before the 24th day of July, 1916; and that such paving and guttering be made and done with such material as the mayor and coun- cil shall hereafter det ermine . Sec. 2. The City Engineer shall prepare and file with the City. Clerk on or before the 19th day of July, 19169 estimates of the cost of making the above described improvements, and after the filing of such estimates the mayor and counc it may advertise for bids for the making of such improvements, or they may let a contract for the making of such improvements without receiving bids, to the most satisfactory company or person. Sec. 3. After the passage and publication of this ordinance the mayor and council shall appoint three disinterested household- ers, who after having taken an oath to faithfully and impartially appraise all lots and pieces of ground liable to assessment and taxation for the cost of such improvements, shall, within ten days after dieing notified of their appointment, proceed to --appraise said -lots and pieces of ground liable to taxation and assessment, as aforesaid, without regard to the buildings and improvements thereon, and after making such appraisement they shall return the same to the mayor and council at the first regular meeting thereof after the completion of such appraisement, and after such appraisement is returned to the mayor and council they shall designate a time.for holding a special session for the purpose of hearing complaints and equalizing said appraisement, of which special session due notice shall be given in the official city paper. sec. 4. For the purpose of paying for the work and improvement herein provided for the mayor and council are hereby authorized and directed to issue bonds of the city of Salina, Kansas, in an amount not to exceed the cost of such improvements, and to run for a period of ten years and payable in ten equal annual installments, together with interest at such rate as the mayor and council shall hereafter determine, _not to exceed however five per cent per annum, which bonds shall be made payable at the fiscal agency of the State of Kansas, and for the purpose of paying principal and interest on said bonds as they severally become due and payable the mayor and council shall by ordinance apportion and assess against the lots and pieces of ground in the taxing district of said improvements special assessments covering the cost of such improvements, and the apportionment therein contained shall hold good for all of the In- stallments that are to be collected from the specific property chargeable with the cost of said improvements, said aseessment+.. and apportionment ordinance shall contain the total amount of the tax apportioned against each tract and parcel of ground within the said taxing district and shall state the number of annual installments in which such tax is to be collected; and the city clerk shall annually thereafter, at the same time other taxes are certified certify to the county clerk of Saline County, Kansas, a full list of all the property liable for the cost of such improvements, to- gether with the respective amounts due upon each of such tracts and parcels of ground, which amounts shall include the annual install- ment and interest for one year on all unpaid balances at such rate as said above mentioned bonds shall bear, and such amounts so certi- fied shall be collected as other taxes are collected; Provided that for the cost of improveing the squares and areas formed by the cross- ing ross- ing of streets and alleys as well as where the improvement is through or adjacent to city property, for which the city would be liable, the assessments shall be made against all the taxable property of the C ity. 1 1 i 1 See. 5 .
