1967 Sewer Improvements2bP(;H .� 1 1 1 1 ORDINANCE _NQ•.' 1967 . - - - -------- - - ------- - - - - --- (Published in the Salina Daily Union July - y---- Zjo&, l 1916) An ordinance providing for the construction of certain sewers in the city of- Salina, Kansas-, letting the contract therefor, and providing for the payment of the cost of the same. WHEREAS, plans and specifications for certain sewers here- inafter described have been made and prepared by the city engineer and -have been approved by the Mayor and Council; and WHEREAS, bids for the construction of such sewers have been advertised for by .said- City and are now on file with the City Clerk, therefore; Be it ordained by the Mayor and Councilmen of •the City of Salina: Section 1. That the Mayor and Council deem it necessary and hereby order that the following described sewers be built and constructed, and the following catchbasins and manholes be built and constructed, in the city of Salina, Kansas•, to -wit: 1. 2300 feet of ten inch sewer on Center Street, Fourth Street and Prescott Avenue, at and for the price of Fifty-six cents (56¢). per lineal foot, for the lineal feet of such sewer actually built and constructed; Six - manholes for such sewer at and for the price of Twenty -Eight (28.00) each and twelve feet of cast iron pipe at and for the price of Two Dollars per lineal foot. - 2 . - 860 lineal feet of ten inch sewer on Morrison Avenue, from Eleventh to Phillips Streets, at -and for the price fifty-four and one-half cemets (542) per lineal foot for the lineal feet actual- ly .built and constructed; one manhole therefore at the price of Twenty -Seven and 50/100 Dollars, ($27.50). 3. 705 feet of ten inch sewer on Twelfth Street from South Street to Morrison Avenue at and for the -price of fifty-five cents (55¢) per foot for the feet of such sewer actually constructed and built; two manholes therefore at and for the price of Twenty- eight Dollars, ($28.00) each. 4. 560 feet of ten inch sewer in the alley between Front and Second Streets, -north of Pine Street, at and for the price of Foflty-seven and one-half cents (47-21-0 per lineal foot for the line- al feet of such sewer actually built and constructed; two manholes therefore at the price of twenty-four and 50/100 dollars, (24.50) each; twelve lineal feet of cast iron pipe at and for the price of Two Dollars ($2.00) per lineal foot. 5. 150 feet of ten inch sewer to drain Second Street in said city of Salina, Kansas, such sewer to be built and constructed near Pine Street as di reet ed - by the city engineer of said City, at- and tand for the price of forty-four (44�) per lineal foot for the lineal feet -of such sewer actually built and constructed; one catchbasin therefore at and for the price of Seventeen Dollars, ($17.00). 6. 240 feet of ten inch sewer in the alley between Walnut and South Streets at and for the price forty-eight cents (48¢) per lineal -foot for the lineal feet of such sewer actually built and constructed; one manhole therefore at and for the price of Twenty - Five Dollars (25.00); one catchbasin therefor at and for the price of Twenty -Four and'75/100 Dollars, ($24.75); and one catch - basin at and for the price of $29.43. 7. 189 feet of ten inch sewer to drain Twelfth Street in said city of Salina, Kansas, at and for the price of fifty-eight_ cents (58¢) per lineal foot. for the lineal feet of such sewer actually built and constructed; two catchbasins therefore; complete with forty-five feet of pipe, at and for the price of $32.55 each; thirty-six feet of ten inch cast iron pipe therefore, at and for the price of Two Dollars .($2.00) per lineal foot. 8. One manhole- on Bishop Street, -west on Ninth Street, complete in place at and for the price' of - $27:50; -ons catchbasin on the north side of 'Bishop- with 22 -feet - of cast iron pipe at and for the price of $23.58; one-catchbasin'on the north side of Bishop with 25 feet of cast iron pipe at and for the price of $24.75. 9. One catchbasin at -the corenr of Tenth and Bishop Streets at and for the price of $15.00 without pipe; and one catchbasin at the northeast corner of such streets, with 65 feet of ten inch cast iron pipe at and for the price of Fof't y Dollars, ($40.00) 10. One catchbasin on Bishop, with 64 feet of ten inch pipe, at and for the price of $39.96; and one catchbasin oh Bishop with 40 feet of ten inch pipe, at and for the price of $30.60. 11. One catchbasin on the north side of Bishop Street, west of entrance to depot grounds, with 60 feet of ten inch pipe, at and for the price of $38.40 12. 225 feet of ten inch sewer on Phillips Street north of University Place, at and for the price of Fifty-eight cents (58¢) per lineal foot, for the lineal feet of such sewer actually built and constructed; one manhole therefor at and for the price of $27.50; one catchbasin on the west side; complete in place with 20 feet of pipe, at and for .the price of $22.80; and one catchbasin on the east side, complete in place with 20 feet of pipe, at and for the price of $22.80 13. One manhole with iron top, steps and trap, six feet deep, at and for the price of $27.50. 14. One manhole complete with iron top steps, without steps, six feet deep, at and for the price of $25.00. 15. All manhd)jes herein mentioned to be of such depth as the city engineer shall direct and for each additional foot in depth, over and above what is at present contemplated, and on which the bid and proposal therefore was made, the contractor, shall receive the additional price of $2.00 for each such additional foot in depth. 16. Bricg work in the above mentioned catchbasins, -as directed by the city engineer, at and for the price of $8.00 for each catchbasin. 17. Cast iron tops for the above mentioned catehbas ins, as directed by the city engineer, at and for the price of $8.00 each, in-place on such catchbasins. 18. Ten inch sewer pipe leading from the catchbasins to manholes, as directed by the'eity engineer, pipe to be of same quality as specified for other work, . including labor of cutting in and connecting same with manhole and all other work and material in connection with laying such pipe and connecting same, at and for the price of Forty-two cents (42¢) per lineal foot for the lineal feet of such pipe actually laid and put in place. See. -2. The plans and spec if icst ions of the_ city engineer of said city of Salina, for.the above described sewers, dated June 19, 1916, and now on file with the city clerk, are hereby adopted and approved as and for the plans and specifications for the construct ion of the above descirbed sewers and parts of sewers and such plans and specifications are hereby made a part of this ordinance as fully as if set out at length herein, and all work and improvements herein specified shall be . done in strict. accordance with such plans and specifications and under the'direction of the city engineer aforesaid. Sec. 3. That a contract be and is hereby let to C. Knudsen and L. C. Ahart for the building and construction of the sewers and parts of sewers hereinbefore specified at and for the prices hereinbefore specified; such prices to include and cover all labor and material necessary for the proper construction _and completion of said sewers and parts of sewers, all of such sewers and parts of sewers in place as a part of the sewer system of the city and as 1 1 1 2bPGII 1 1 1 1 specified in the said plans and specifications for the construction thereof. See. 4. Said C. Knudsen and L • C • Ahart shall execute a written contract with said City for the building and construction of said sewers and.parts of sewers according to the terms of said plans and specifications and this ordinance, and shall file with the city clerk good and sufficient bonds to said City, in such amount, not exceeding the total amount of said contract price, as the mayor shall direct, conditioned that they will build, and complete such sewers according to the said plans and specifications; that they will properly refill the ditches made by them for the construction of such sewers according to the ordinances.of.the city; that they will fulfill the guaranty set out in the above-mentioned plans and specifications; that they will hold and save harmless the city of Salina from all damage to persons or property which may arise by reason of the -construction of such sewers and parts of sewers or through the carelessness or neglect of such contractors, their servants or employees, and that they will protect the said City from and against all liens for laboror material -used and employed in the building and construction of such sewers and parts of sewers See. 5. The cost and expense of constructing and completing such sewers and parts of sewers shall be assessed against all lots and pieces of ground contained in the city of Salina as a sewer district, as provided by Ordinance No. 613, passed and approved December 23, 1887, and the mayor and council are hereby authorized to provide for the payment therefore by installments .instead of levying the entire cost thereof as one -special assessment at one time, and for such installments they may issue sewer improvement bonds of the city of Salina, payable in insbllments of equal amounts each year, none of which bonds, nor the installments thereof, shall run. longer than ten years nor bear interest exceeding five per cent per annum, and such bonds may be delivered to the contractors constructing such sewers in payment therefor; or the mayor and coun- cil may sell such bonds at not less than their par value and'pay said contractors out of the proceeds thereof, and for the purpose of paying principal and interest on such bonds as they severally become due., -the mayor and council, shall each year during the life of such bonds levy a tax or special assessment against all taxable real property in said City of Salina, at the assessed value thereof for general revenue purposes, in an amount sufficient to pay the princi- pal of such bonds for that year, and the city clerk shall certify said assessments and special taxes as they are severally made and levied as aforesaid, to the county clerk of Saline County, Kansas, at the same time and in the same manner as other taxes of said City are redrt if ied. Sec. 6. The said contractors shall properly refill all excavations made by them in the construction of such'sewers accord- ing to the plans and specifications of the city engineer aforesaid, and shall properly re -fill such excavations if any sinking or de- pression appear therein within a period of two years after the acceptance of said sewers by said City. Sec. 7. This ordinance shall take effect and be in force from and after its publication once in the Salina Daily Union. Passed and approved, July 17, 1916. J . E. Putnam, Mayor. (SEAL) Attest: Chas.
