1960 Improve Fourteenth Street2bPGII 1 1 1 1 --- -- ---- -- -- 0-R D _I N A N C E - - N 0 . 196 0 - - -- --- ------ -- - - An ordinance -providing for the paving, curbing, guttering, excavat- ing and ,filling of Phillips or Fourteenth Street, in the city of Salina, Kansas, from the south line of the right - of -way of the Union Pacific Railroad Company -to the south line of the right-of-way of the Missouri Pacific Railway Company; and for the paving, curbing, guttering and exca- vating of Twelfth Street in said City, from the north line of Bishop Street to the south side of Noith Street; and providing for the cost of such improvements and the manner of payment. - n WHEREAS, by resolutions duly adopted on the 3rd day of April, 1916 and the 17th day of April, 1916, the Mayor and Council declared it necessary to pave, curb, gutter and excavate the above mamed streets in the city of Salina,. Kansas, within the limits above de- fined; e- fined; and WHEREAS, said resolutions were published for five consecutive days in'the Salina Evening'Journal, a daily newspaper published in the city of Salina, Kansas, and WHEREAS., a majority of the resident property owners liable to assessment for the cost of such improvements did not, within twenty days from the last publication of said resolutiori, file with the City Clerk their -protest against the making of such improvements or the making_ thereof; therefore, Be it ordained by the Mayor and Councilmen of the City of Salina: Section 1. That it is necessary and hereby ordered that Phillips or Fourteenth Street, in the city of Salina, Kansas, from the south line of the right-of-way of the Union Pacific Railroad Company to the south line of the right-of-way of the Missouri Pacific Railway Company, and Twelfth Street in said City, from the north side of Bishop Street to the south side of North Street, be paved, curbed, guttered, excavated and filled according to the plans and specifications of the City Engineer of said City, now on file with the City Clerk, for the making of such improvements, and with such material as the mayor and Council may hereafter designate; such paving to be of such width as the mayor and council may hereafter designate. v Sec. 2. The City Engineer shall prepare and file with the City Clerk, on or before the 26th day of June, 1916, estimates of the cost of making such improvements, and after the filing of such estimates the mayor and council may advertise for bids for the mak- ing of such improvements or they may let a contract for the making of such improvements to the most satisfactory party or company with- out advertising for or receiving bids. Sec. 3. After the passage and publication of this ordinance the mayor and council shall appoint three disinterested householders who after having taken an oath to faithfully and impartially ap- praise all lots and pieces of ground liable to assessment and taxa- tion for the cost of the improvements herein provided for, shall, within ten days after being notified of their appointment, proceed 0 1 78 to appraise said lots and pieces of ground liable to taxation and assessments, as aforesaid, without regard to the buildings or im- provements thereon, and after the making of such appraisement they shall return the same to the mayor and council at the first regu- lar meeting thereof after the completion of such appraisement, and after such appraisement is returned to the mayor and council they shall designate a time for holding a special session for the pur- pose of hearing complaints and equalizing said appraisement, of which special session due notice shall be given in the official city paper. Sec. 4. For the purpose of paying for the work and improve- men.ts herein provided for the mayor and council are hereby author- ized and directed to issue bonds of the city of Salina, in an amount not to exceed the cost of such improvements, and to run for a period of ten years and payable in ten equal annual installments, together with interest at such rate as the council shall hereafter determine, not to exceed however five per cent per annum, which bonds shall be made payable at the fiscal agency of the state of Kansas, and. -for the purpose of paying princiapal and interest on said.bonds as they severally become due and payable the mayor and council shall by ordinance apportion and assess against the lots and pieces of ground in the taxing district of said improvements special assessments covering the cost of said improvements and the apportionment therein contained shall hold good for the install- ments that are to be collected from the specific property chargeable for the cost of said improvements. Such assessment and apportion - Ment ordinance shall contain the total amount of the tax apportion- ed each tract, piece and parcel of ground within the taxing district and shall state the number of annual installments in which such tax is to be collected; and thereafter the city clerk shall annual- ly at the same time other taxes are certified, certify to the coun- ty clerk of Saline County, Kansas, a full list of all property lia- ble for the cost of such improvements, together with the respect t ive amounts due upon each of such tracts and parcels of ground, which amounts shall include the annual installments and the inter- est for one year on all unpaid balances at such rate as said.above mentioned binds shall bear, and such amounts so certified shall be collected as other taxes are collected; Provided that for the purpose of defraying the cost of improving the squares and areas formed by the crossing of streets and alleys as ,well as where the improvement is through or adjacent to city property, for which the 1 1 1 1 1 2bPGH 1 II II II 1 City would be liable, the assessments shall be made against all the taxable property of the City. Sec. 5. This ordinance shall take effect and be in force from and after its publication once in the Salina Daily Union. Passed and approved June 19th, 1916. (SEAL) Attest: Chas, E.
