1955 Improve Twelfth Street-------------- --- -- --- - - - ORDINANCE _NO.-_ 1955:- -- yc-P/ / d 1916) An ordinance providing for the paving, curbing, guttering and exca vat ing of Twelfth Street in the city of Salina, Kansas, bet= tween the south line of Bishop Street and the north line of Ash Street, and providing -for the cost thereof and the manner of payment. Be it ordained by the Mayor and Councilmen of the City of Salina: Section 1. That it is necessary and hereby ordered that Twelfth Street in the city of Salina., Kansas, between the north line of Ash Street and the south line of Bishop Street be paved with such material as the council may hereafter designate, as herein- after erein- after provided, according to the specifications of the city engin- eer of said City hereinafter provided for, said street to be paved for such a width as the Mayor and Council shall hereafter determine; Provided that the intersections of streets and alleys such paving shall .return to the lot line of said street so improved. Sec. 2. It is necessary and hereby ordered that said Twelfth Street between the limits aforesaid be curbed and guttered on both sides thereof with cement curb and gutter, according to the plans and specifications of the City Engineer, hereinafter provided' for, the curb part thereof to be six inches in thickness and the gutter part thereof to be forty-two (42) inches from the back edge of such curb to the paving line of such gutter and the lot line edge of such curbing shall be set such a distance from the center line of said street as the mayor and council shall hereafter de- termine; Provided that at the intersection of streets and alleys such curbing and guttering shall return to the lot line on said street improved. Sec. 3. For the work and improvement herein provided for the City Engineer shall make and file with the City Clerk on or before the 19th day of June, 1916, plans and specifications for the paving, curbing, and guttering of such street and on or before said date the City Engineer shall file with the City Clerk an, esti- mate of the cost of making such improvements. Sec. 4. All excavating, grading and filling necessary to be done for the proper construction of said improvements shall be done and the plans and specifications and estimate of the City Engineer aforesaid shall include such grading, excavating and filling. After such plans and specifications and estimate shall have been made and prepared and filed with the City Clerk, as aforesaid, the Mayor and Council may advertise for bids for bids for the construction of such improvements, and after the re- ception of such bids the Mayor and Council shall select the mater- ial with which said street is to be paved, and they may and are hereby authorized to let a contract for the construction of such improvements to the most satisfactory bidder, said mayor and coun- cil reserving the right to let the contract for the said paving and curbing and guttering separately and may reject any and all bids; Provided that said mayor and Council may let a contract for the construction of such improvements without advertising for bids as aforesaid. Sec. 6. After the passage and publication of this ordinance the mayor and council shall appoint three disinterested house- holders of the City, who, after having taken an oath to faithfully and impartially appraise all lots and pieces of ground liable to taxation for the cost of such improvements herein provided for, shall within ten days after having been notified of their appoint- ment, proceed to appraise said lots and pieces of ground liable to assessment and taxation, as aforesaid, without regard to the build- ings or improvements thereon, and after making such appraisement shall return the same to the mayor and council at the first regu- together with interest at such rate as the mayor and council shall hereafter determine, which bonds shall be made payable at the fis- cal agency of the State of Kansas, and for the purpose of paying principal and interest on such bonds as they severally become due the mayor and council shall by ordinance apportion and assess against lar mebt ing thereafter, and after such appraisement shall have returned to the Mayor and Council said Mayor and Council shall designate a time for a special meeting for the purpose of hearing complaints and equalizing such appraisement, of which special session due notice shall be given in the official city paper of the City, and at such special session the mayor and council shall if they deem it just and equitable, alter and change such appraise- ment. Sec. 7. For the purpose of paying for the wotk and improve- ment herein provided for the mayor and council are hereby author- ized and directed to issue bonds of the City of Salina, in an amount not to exceed the cost of such improvements and to run for a of ten and in installments, period years payable ,ten equal annual together with interest at such rate as the mayor and council shall hereafter determine, which bonds shall be made payable at the fis- cal agency of the State of Kansas, and for the purpose of paying principal and interest on such bonds as they severally become due the mayor and council shall by ordinance apportion and assess against the lots and pieces of ground in the taxing districts of such improvements, special assessments covering the cost of such improve- ments and the apportionment therein contained shall hodl good for all the installments that are to be collected from specific property chargeable with said improvements. Such assessment and apportionment ordinance shall contain the total amount of tax apportioned to each tract, piece and parcel of ground within the taxing district and shall state the number of annual installments in which such tax is to be collected, and thereafter the city clerk shall annually at the same time other taxes are certified, certify to the county clerk of Saline County, Kansas, a full list of all property liable for the cost of such work and improvements, together with the re- spective amounts due from each of such tracts, pieces and parcels of ground, which amounts shall include the annual installments of in- terest on all unpaid balances for one year at such rate as said bonds shall bear, and such amount so certified shall be collected as other taxes are collected; Provided that the cost of improving the squares and areas formed by the crossing of streets and alleys as well as where said improvements are through or adjacent to city prop- erty, for which the City would be liable, the assessments shall be against all the taxable property of the City.
