An ordinance' vacat ing a certain portion of . Bishop Street in the
. city of Salina, Kansas as hereinafter described.
Be it ordained by the Mayor and Councilmen _ of the city of Salina:
Sect ion 1. In consideration of the execution and delivery by
the Missouri Pacific Railway Company, to the city of Salina, Kansas,
of a deed to the following described tract of land, to -wit:
All that tract of land lying north of the southerely line
of the present right-of-way of the Missouri Pacific Railway Company
and south of the following described line; Beginning at the intersec-
tion of the west line of Thirteenth Street, produced north, with
the south line of Bishop Street, produced west, fifty-five (55) feet
north of the south line of the present property of said Missouri
Pacific Railway Company, thence in a southwesterly direction, by a
right line, two hundred twenty-f-ive (225) feet to a point fifty -(50)
feet southeasterly from and radial to the center line of''the located
main line track of the said Railway Company, thence southwesterly
fifty (50) feet- from and parallel to the said center line to the east
line of College Avenue or Fifteenth Street.
.Receipt of which deed ishereby acknowledged and receipt is
hereby acknowledged, by the city of Salina, of a waiver of damages,
executed by the Missouri Pacific Railway Company, waiving any and all
damages which may be caused to such Railway Company on account of the
condemnation and appropriation by the city of Salina of the follow-
ing described property, which waiver is also a part of the considera-
tion for the passage of this ordinance, and which property is de-
scribed as follows, to -wit:
All that portion of the present right-of-way of the Missour-i
Pacific Railway Company lying between Twelfth and Thirteenth Streets
in the city of Salina, Kansas, and south of a line thirty-three (33)
feet south of and parallel to the center, line of the main line track
of the said Missouri Pacific Railway Company as now located.
In consideration of which acts, as aforesaid, that portion of
Bishop street in the city of Salina, Kansas, between the center line
of Thirteenth street and the west line of Twelfth Street and lying
north of a line thirty-three (33) feet south of and parallel to the
center line of the main line track of the said Missouri Pacific Rail-
way Company, as now located, is hereby vacated and discontinued as
and for a street in said City.
- Sec. 2. Ordinance No. 1933, passed and approved April 17,
1916, is hereby. repealed .
Sec. 3. This ordinance shall take effect and be in force from
and after its publ icat ion once in the Sa 1 ina Evening Journal.
