An ordinance providing for the paving, curbing, guttering and
excavating of -Phillip's Street in the city of Salin4, Kansas,
between the- north- side- of Walnut Street and the south side
of Ash Street, providing for the cost thereof and the manner
of payment.
WHEREAS, there has been presented to the mayor and council
a pet it ion requesting -the mayor and council to pave, curb, gutter
and excavate Phillips Street in the city of Salina, within the
limits aforesaid, and,
WHEREAS, said pet it ion has been found, by said mayor and
council to contain the names of a majority of the resident property
owners owning property fronting on both sides of said Phillips
Street, the distance to be improved as aforesaid, therefore,
Be it ordained by the Mayor and Councilmen of the City of Salina:
Section 1. That it is necessary and hereby ordered that
Phillips Street, in the city of Salina, Kansas, between the north
line of Walnut Street and the south line of Ash Street, be paved
with such material as the mayor and council shall hereafter desig-
nate and select. Such paving to be thirty-one (31) feet in .width
from gutter, except that at the intersections of streets and alleys
such paving shall extend to the lot line on said Phillips Street.
See. 2. It is necessary and hereby ordered that said Phil-
lips Street, between the limits defined in section one hereof be
curbed and guttered on both sides thereof with cement curb and
gutter, according to the plans and specifications hereinafter adopt-
ed, the curb .part thereof to be six (6) inches in thickness and
and the gutter part thereof to be forty-two ('42) inches in thickness
from the back edge of such curb to the paving line of such street,
and the lot line edge of such curbing and guttering shall be nine-
teen (19) feet from and parallel with the center line of said Phil-
lips Street; Provided, that at the intersections of streets and
alleys said curbingand guttering shall extend to the lot line of
said Phillips Street.
Sec. 3. All excavating, rolling, grading and filling for
the proper constructing of said paving, curbing, and guttering
shall be done and such paving, curbing, and guttering shall be laid
and constructed on the established grade of said Phillips Street as
heretofore or hereafter established by the ordinances of the city
of Salina.
Sec* 4. That the specifications of the City Engineer of the
City of Salina, heretofore filed with the city clerk of such city,.
for the work and improvement herein provided for, are hereby adopt -
ed as and for the plans and specifications for such work and i2nprove-
ments. The City Engineer shall herafter file with the city clerk

an estimate of the cost of the work and improvement herein provided
for.
Sec. 5. The mayor and council shall hereafter by ordinance
determine the kind of paving, curbing and guttering to be placed on
the above described street 'and shall let a contract for the construe -
tion of such paving, curbing; and guttering to the most satisfactory
and responsible bidder or person.
Sec. 6. After the passage and publication of this ordinance
the mayor and council shall appoint three disinterested householders
of the city who after having taken an oath to faithfully and impart-
ially appraise all lots and pieces of ground liable to assessment and
taxation for the cost of said improvements, shall, within ten days
after having been notified of their appointment proceed to appraise
said lots and pieces of ground liable to taxation for such Improve-
ments, without regard to the improvements thereon, and after making
said appraisement shall return the same to the mayor and council,
and after such appraisement is returned to the mayor and council, th e
said mayor and council shall designate a time for holding a special
session for the purpose of hearing complaints and equalizing said
appraisement, of which special session due notice shall be given
In the official city paper, and at said special session, the mayor and
council shall, if they deem it just and proper, alter or change such
appra isement ,
Sec. 7. For the purpose of paying for such paving, curbing,
guttering and excavating, the mayor and council are hereby directed
and authorized to issue bonds of the city of Salina, in an amount not
to exceed the contract price thereofor, and to run for such a period
of time as the mayor and council. shall determine, not to exceed how-
ever ten years, from the date of such bonds, and to be payable in
equal amounts .,each year during the, life of such bonds, together with
Interest not to exceed the rate of five per cent per annum, which bonds
shall be Payable at the fiscal agency of the State of Kansas, and
for the purpose of paying .principal and interest on such bonds as Chet
severally become due the mayor and council shall each year, during
the life of -such bonds, levy an assessment against the lots and plea -
es of ground liable for taxation for the improvements herein provid3d
for, in an amount sufficient to pay the principal and interest for
that year; Provided, that for the purpose of defraying the cost of
paving and otherwise the squares and areas formed by the crossing of
streets and alleya, as well as where the improvement is through or
adjacent to city property, for which the city could• be liable, the

assessment shall be .made against all of the taxable property of the
City, and the city clerk shall certify said assessments, as they are
severally made, to the county clerk of Saline County, Kansas, at the
same time and in the same manner as other taxes are certified, and
said assessments shall be liable to the same penalties as other tax-
es; Provided that the mayor and council shall by ordinance apportion
and assess the special assessments aforesaid against the lots and
pieces of ground in the taxing district for said improvements which
assessment and apportionment shall hold good for all the install-
ments, that are to be collected from the specific property chargeable
with said improvements.
See. 8. This ordinance shall take effect and be In force from
and after its publication once in the Salina Evening Journal.
