1943 Street Improvements Penn AvenueORD I N A N CE N 0. 1943. (Published in the Salina Evening Journal 1I -)ii —,./ An ordinance providing for the curbing and guttering of Penn Avenue in the -city of Salina, Kansas, from the north side of Iron Avenue to -the south'side of Ash Street, specifying the manner - of construct ion, providing for the cost thereof and the manner of payment. WHEREAS, - a -pet it ion has been presented, to the mayor and council requesting said mayor and c ounc it ' t o curb and gutter Penn Avenue within the limits above mentioned; and, WHEREAS, . said- pet it ion has been eXamined by said mayor and council and has been found to contain- the - names of a majority of the property owners resident in Salina and owning property fronting on said Penn Avenue and liable to taxation for such improvements; therefore, Be it ordained by the Mayor and Councilmen of the City of Salina: Section 1. That it is necessary and is hereby ordered that Penn Avenue in the city of Salina, Kansas, between the north line of Iron Avenue and the south line of Ash Street,. be turned and gut- tered on both sides thereof, with cement curb and gutter, such curb to be six (6) inches in thickness and such gutter to be forty-two (42) inches in width from the back edge of such curb to the paving line of such street, and the lot line edge of such curb shall be set nineteen (19) feet from and parallel with the center line of said Penn Avenue. Sec .. 2 . The plans and specifications of the city engineer of the City of Salina, for the making of the above mentioned Improve- ments are hereby adopted as and for the plans and specifications for the making of such improvements and all of such improvements shall be made and constructed according to such plans and specifics- tions; provided that at the intersection of streets and alleys such curbing and guttering shall return to the lot line of such Tenn Avenue. See. 3. After the passage and publication of this ordinance the mayor and council shall appoint three disinterested householders who, after having taken an oath th faithfully and impartially ap- praise all lots and pieces of ground liable to assessment and taxa- tion for the cost of such improvements, shall within ten days after being notified of their appointment, proceed to appraise said lots and pieces of ground liable to taxation for said improvements as aforesaid, without regard to the buildings and improvements there- on, and after making such appraisement shall return the same to the mayor and council at the first regular meeting thereof after such appraisement shall have been made and completed, and after said ap- praisement shall have been returned to the council, the mayor and council shall designate a time for hold ing -a special meet ing for the purpose of hearing complaints and equalizing said appraisement, of 1 LJ 1 1 1 2Ul ` tl 1 1 D 11 1 which special meeting due notice shall be given in the official city paper, and at such special meeting the mayor and:`. Counc it shall if they deem it just and equitable alter or change such appraisement. See. 4.• For the purpose of lying for the work and improvement provided for in this ordinance, the mayor and council are hereby authorized and directed to issue bonds of the city of Salina in an amount not to exceed the contract price of making such improvements, and to run for a period of four years and payable in four equal annual installments, together with interest at not to exceed five percent per annum, which bonds' shall be made payable at the fiscal agency of the State of Kansas; and for the purpose of paying princi- pal and interest on said bonds as they severally become due the mayor and council shall by ordinance apportion and assess against the lots and pieces of ground liable for the cost of said improvements spe- cial assessments covering the cost of such improvements, and the apportionment therein contained shall hold good for all the install- ments that are to be collected from the specific property chargeable with such improvements. Such assessment and apportionment ordinance shall contain the total amount of tax apportioned to each tract, piece and. parcel of land within the taxing district for said improvements and shall state the number of annual installments in which such tax is to be collected; and thereafter the city clerk shall annually at the same time other taxea are cert if ied, certify to the county clerk of Saline County, Kansas, a full list of all property liable for such work and improvements, together with the respective amounts due on each of such tracts, pieces and parcels of ground, which amount shall include the annual installments together with the interest on all un- paid balances for one year at such rate as the bonds issued in pur- suance hereto shall bear, and such amounts so certified- shall be col- lected as other taxes are collected; Provided, that for the purpose of defraying the cost of improving the. squares and areas formed by the ®intersection of streets and alleys as well as where such -improve- ments are through or, adjacent to city property, for which the city would be liable, the assessments shall be made against all the taxa- ble property of the City. Sec. 5. This ordinance shall take effect and be in force from and after its passage and publication once in the Salina Eve- ning Journal. Passed and approved, May 15th, 1916.. -J. EA.
