1933 Vacate Bishop Street28 a rg E"I 11 A 1 9 CI �� � � _ C -A 0 R D I N- A N C E N_Q. 1933 - - -------- - ---- -- (Published in the Salina Evening Journal An ordinance vacating a certain port ion of Bishop Street in the City of Salina. WHEREAS, The Missouri Pacific Railway Company is desirous of hav- ing a portion of Bishop -Street in Salina, Kansas, between the east line of Thirteenth (13th), Stre- et -and the west ' line of Twelfth (12th) Street vacated, and in consideration therefor, the said Railway Com- pany has agreed to convey to the City of Salina for street purposes, the following described property: All that tract of land lying north of the southerly line of the present right-of-way of said Railway Company and south of the follow- ing described line: Beginning at the intersection of the west line of Thirteenth Street produced north, ,with the south line of Bishop Street produced west, Fifty -Five ' (55) feet north of the south line of the present property of the railway company; thence- southwesterly direction by a right line, Two Hundred Twenty -Five (225) feet to a point Fifty (50) feet southeasterly from'and radial to the center line of the located main track of The Missouri Pacific Railway Company; thence southwest- erly Fifty (50) Feet from and parallel to said centerline of the east line of Fifteenth (College) Street. And further, The Missouri Pacific Railway Company agrees to waive and claim for damages on account of said City of Salina acquir- ing through condemnation proceedings that portion of their present right of way between Twelfth (12th) and Thirteenth (13th) Streets ly- ing south of a lne'Thirty-three ' (33) feet south of and parallel with, when measured at right angles, the center line ,of said main track of said Missouri Pacific Railway Company as now located, therefore, Be it ordained by the Mayor and Councilmen of the City of Salina: Section 1. That in consideration of the above mentioned con- -dit ions to be performed by the said Miss our i Pacific Railway Company, all that portion of Bishop Street in the City of Salina, Kansas, between the center line of Thirteenth Street and the west line of Twelfth Street, lying north of a line Thirty -Three (33) feet south of the cen- ter of the main track of The Missouri Pacific Railway, as now located, excepting the south ten (10) feet thereof extending from the west line of. Twelfth Street to the west line of alley in Block Thirteen (13) Depot Addit ion, extended south, - reserve for sidewalk, be and the same is hereby vacated and discontinued as a street in said City, Sec. 2. This ordinance shall take effect and be in force from and after its publication once in The Salina Evening Journal and the receipt by the City of Salina, from The Missouri Pacific Railway Com- pany, of a deed, conveying to the City of Salina, Kansas, all that portion of the present right-of-way of said Missouri Pacific Railway Company, in the City of Salina, Kansas, lying south of the following described line: 1 1 1 1 1 2bPG11 1 rel 1 Beginning at the intersection of the west line of Thirteenth (13th) Street; produced north,, -with the south line of Bishop Street produced west, such point being fifty-five (55) feet north of the south line of the present right-of-way of said Railway Company, thence in a southwesterly direction, by a right line, Two Hundred Twenty - Five (225) feet to a point Fifty (50) feet southeasterly from and radial to the center line of the located main track of the Missouri Pacific Railway Company, thence southwesterly Fifty -(50) feet from and parallel to said center line of the east line of Fifteenth (College) Street: And upon the further receipt by the City of Salina, from said Missouri Pacific Railway Company, of a waiver of all damages which might result to said Railway Company by reason of the taking, by said City, for use as a street, of that portion of the right-of-way of such Railway Company lying between Twelfth Street and Thirteenth Street in Salina, Kansas, and south of a line .'thirty-three (33) feet south of and parallel with, measured at right angles, the center line of the main track of said Railway as located.
