1928 Improve Tenth Street2bPG11 1 1 1 1 ORD INAN CE No. 1928 (Published in the Salina Even -in -a Journal April 1916.) An ordinance providing for the -curbing and guttering of Tenth Street from the north line of Lincoln Avenue to the south line of Grand Avenue; Third Street from the south line of Walnut Street to the north line of Mulberry Street; Second Street from the south line of Walnut Street to the north line of Mulberry Street; Vifth. Street from the . south side of Prescott Avenue to the north line ob Bond Street ; Elm Street from the east line of Fourth Street to the east line of Front Street; and providing for the paving, curbing, guttering and excavating of Tenth Street from the south side of Morrison Avenue to the north line of Prescott Avenue; Twelfth Street from the south line of Walnut Street and the north line of South Street; Tenth Street from the north line of Ash Street and the south line of Park Street; and further providing for the paving and excavat- ing of walnut Street from the west line of College Avenue to the ,east line of the right of way of the Missouri Pacific Rail- way Company, all of such streets being in the city of Salina, Kansas. Be it ordained by the Mayor and Councilmen of the city of Salina : SECTION 1. That it is necessary and hereby ordered that the following streets in the city of Salina, Kansas, within the limits hereinafter set forth, be curbed and guttered on both sides thereof: Tenth Street from the north line of Lincoln Avenue to the south line of Grand Avenue Third Street from the south line of walnut' Street to the north line of Mulberry Street. _.Second Street from the south line of walnut Street to the north line of Mulberry Street. _Fifth Street from the south line of Prescott Avenue to the north line of Bond Street _tlih Street from the east line of Fourth Street to the east line of Front Street. All of such streets shall be curbed and guttered with cement curbing and guttering, according to the plans and specifications of the City Engineer hereinafter provided for, the curb . part thereof to be six (6) inches in thickness and the gutter part thereof to be forty-two (42) inches from the back edge of such curb to the paving line of such street being so curbed and guttered, and the lot line edge of such curbing shall be such distance from the center lines of said streets as the mayor and council shall hereafter determine. SECTION 2. That it is necessary and hereby ordered that Tenth Street from the south line of Morrison Avenue to the north line of Prescott Avenue, Twelfth Street from the south line of Walnut Street to the north line of South Street, and Tenth Street from- the north line of Ash Street to the south line of Park -Street be curbed, guttered, paved and excavated, and that walnut Street from the west line of Col- lege Avenue to the east line of the right of way of the Missouri Pa- cific Railway Company be paved and excavated, all of such streets being in the city of Salina, Kansas, Such paving, curbing and guttering shall be constructed according to the plans and specifica- tions of the City Engineer of the City of gal ina, Kansas, herein- after provided for., and all excavating, rolling and filling shall be done as is necessary for the proper construction thereof, and such paving shall be laid on the established grades of said streets. The curbing and guttering provided for in this section shall be cement curb and gutter six inches in thickness and the gutter part thereof to be forty-two (42) inches from the back edge of such curb to the paving line of said streets on which it is being placed, and the paving provided for in this section shall be of such width as is hereinafter set forth and shall be of such material as the mayor and council shall hereinafter determine. SECTION 3. . The paving provided for in section two hereof shall be the following widths, to -wit: Tenth -Street from the south line of Morrison Avenue to the north line of Prescott Nineteen (19). feet from gutter to gutter. Twelfth Street from the south line of Walnut to the north line of South, Thirty-one (31) feet from gutter to gutter. Tenth Street from the north line of Ash to the south line of Park, Thirty-one (31) feet from gutter to gutter. Walnut Street- from the west line of College to the east line of the right of way of the Missouri Pacific Railway Company Thirty-one (3I) feet from gutter to gutter. SECTION 4* For all of the work and improvements provided for in this ordinance the City Engineer shall make and file with the city clerk of said City on or before the 7th day of April, 1916,- plans and specifications for the construction of such im- provements and on or before the last named date the City Engineer shall make and file with said City Clerk as estimate of the cost of such improvements. SECTION 5. The Mayor and Council shall advertise for bids for the construction of such improvements and after the filing of said plans, specifications and est imate may let the contract for the construction of such improvements to the most satisfactory bidder or bidders as determined by the mayor and council; or said mayor and council may reject any and all bids for the making of said improvements. SECTION 6. After the passage and publication of this ord- inance the mayor and council shall appoint three disinterested appraisers, who after having taken an oath to faithfully and im- 1 1 1 2bPGH 1 1 partially appraise all lots and pieces of ground liable to taxation and assessment for the cost of the improvements herein provided for, shall, within ten days after having been notified of their appoint- ment,, ppoint- ment, proceed to appraise said lots and pieces -of ground liable to assessment and taxation for the making of the improvements herein provided for, without regard to the buildings and improvements thereon, and after making said appraisement shall return the same to the mayor and council at the first regular meeting after the com- pletion of such appraisement, and after such appraisement is returned ° ) I to the mayor 'and council the mayor and council shall designate a time for holding a special meeting for the purpose of hearing com- plaints om- plaints and equalizing said appraisement, of which special meet ing due notice shall be given in the official city paper, and at said special meeting the mayor and council shall., if they deem it just and .proper, alter or change such appraisement. SECT ION 7. For the purpose of paying for the work and improve- ments mprove- ments in this ordinance provided for, the mayor and council are hereby authorized and directed to issue bonds of the city of Salina, in an amount not to exceed the cost of such improvements, to run for a period of not to exceed ten years and to be payable in not to exceed ten equal annual installments, together with interest at not to exceed five per cent per annum, which bonds shall be payable at the fiscal agency of the State of Kansas; and for the purpose of paying the principal and interest of said bonds as they severally become due and payable, the mayor and council shall apportion and assess, against the lots and pieces of ground within the taxing districts of such improvements, special assessments covering the cost of such improvements, and the apportionment so made shall hold good for all the installments that are to be collected from the specific property chargeable for the making of said improvements. The ordinance fixing and determining such apportionment and assess- ment shall contain the total . amount of tax apportioned to each tract, lot and parcel of ground within such taxing districts, and shall state the number of annual installments in which said tax is to be collected; and thereafter the City Clerk shall annually, at the same time other taxes are certified, certify to the county clerk of Saline County, Kansas, a full list of all property liable for such work and improvements, together with the respective amounts due on each of such tracts, pieces and parcels of ground, which amount shall include the annual installments and interest on all unpaid bal- ances for one year at such rate as said bonds shall bear, and such 17. ---- --- - - ---- ---- - -- --- -- amounts so certified shall be collected as other taxes are collected; Provided, that the cost of improving the squares and areas formed by the; crossing of streets and alleys, and the cost of such improve- ments as are through or adjacent to City property, for which the City would be liable, the assessments shall be made against all the taxable property of the City.
