ORDINANCE NUMBER 10-10536
AN ORDINANCE AMENDING CHAPTER 5, ARTICLE IV, DIVISION III OF THE
SALINA CODE BY AMENDING SECTION 5-150 REGARDING THE DELEGATION OF
AUTHORITY TO REVOKE AND SUSPEND DRINKING ESTABLISHMENT LICENSES.
WHEREAS, it is necessary that the Governing Body, by ordinance, amend Section 5-150 of
the Salina Code to delegate to the city manager the authority to revoke or suspend a drinking
establishment license; SO NOW THEREFORE,
BE IT ORDAINED by the Governing Body of the City of Salina, Kansas:
Section 1. That Section 5-150 is amended as follows:
"Sec. 5-150. Penalty.
If the licensee has violated any of the provisions of this article, the governing body of the
city, or its designee, upon five (5) days' written notice to the person holding such license to
sell alcoholic liquor, may permanently revoke or cause to be suspended for a period of not
more thanthirty (30) days such license and the individual holding the license may be
charged in municipal court with a violation of the alcoholic liquor laws of the city and upon
conviction shall be punished by:
(1) A fine of not more than four hundred ninety-nine dollars ($499.00); or
(2) Imprisonment in jail for not more than one hundred seventy-nine (179) days; or
(3) Both such fine and imprisonment not to exceed subsections (1) and (2) of this
section.
The governing body delegates to the city manager the authority to revoke or suspend a
drinking establishment license consistent with the criteria specified in Sec. 5-102(e)."
Section 2. That this resolution shall be in full force and effect from and after its adoption
and publication once in the official city newspaper.
