09-10527 Reserves of Prairie Glen PDD1 1 (Published in the Salina Journal on December,30, 2009) ORDINANCE NUMBER 09-10527 AN ORDINANCE PROVIDING FOR THE AMENDMENT OF ORDINANCE NUMBER 8526, THE SAME BEING CHAPTER 42 OF THE SALINA CODE, AND THE ZONING DISTRICT MAP THEREIN AND THEREBY ADOPTED AND PROVIDING FOR THE REZONING OF CERTAIN PROPERTY WITHIN THE CITY AND PRESCRIBING THE PROPER USES THEREOF. WHEREAS, all conditions precedent for the amendment of the Zoning District Map, the rezoning of certain property therein, hereinafter described has been timely complied with, SO NOW, THEREFORE,, BE IT ORDAINED by the Governing Body of the City of Salina; Kansas: Section 1. AMENDMENT. DISTRICT "P.D.D. SHOPPING CENTER PLANNED DEVELOPMENT DISTRICT. That the Zoning District Map of the City of Salina, Kansas, duly adopted and published as a part of Ordinance Number 8526, the same being Chapter 42 of the Salina Code and Section 4.1.b. of Ordinance Number 03-10184, be and are hereby amended so that the following described property be rezoned as follows, to -wit: Lot Two (2), Block One (1) of the Overland View Addition to the City of Salina, Saline County, Kansas (aka 2525 South Ohio Street). shall become a part of District "P.D.D. PLANNED DEVELOPMENT DISTRICT. Section 2. CONDITIONS OF APPROVAL. That the use of said described property shall be subject to all the conditions, restrictions and limitations as made and provided for in Ordinance Number 8526, the same being Chapter 42 of the Salina Code with reference to the PLANNED DEVELOPMENT DISTRICT. Development of the property shall be subject to the plans on file with the City Planning Commission and/or City Clerk and the following conditions, to -wit: 1. Development of Lot 2 shall be limited to a 12,000 square feet office building and permitted uses on Lot 2 shall include business and professional offices, business schools and small animal clinics. Lot 2 shall be subject to all bulk, use and signage limitations in the C-1 district regulations. 2. An exception to the 600 ft. maximum distance limitation on shared parking in Section 42-552(8) is hereby granted to allow the First Baptist Church parking lot to be utilized to meet Lot 2's parking requirements. Section 3. That all prior ordinances in conflict herewith as related the above described real estate are hereby repealed. Section 4. That this ordinance shall be in full force and effect from and after its adoption and publication once in the official city newspaper.
