Section 1. That the following special assessments levied
against the tracts of land hereinafter described in the amounts
set forth following a description of each of such tracts as levied
by the provisions of Ordinance No. 4940 of the City of Salina be
cancelled, set aside and remitted for the reasons that the collection
and levying of such special assessments have heretofore been enjoined
by: -the orders of the District Court of Saline County, Kansas in cases
and proceedings on appeal pending in said court, to -wit;

Section 2, That the City Clerk be and he is hereby directed to
file with the County Clerk and County Treasurer of Saline County,
Kansas, certified copies of this Resolution.
Section 3. That if any of the assessments herein above set
forth or any part of the same have been paid by the owner or owners
of any such tract of land to the County Treasurer of Saline County,
Kansas, that such assessment or such part of same has been paid shall
be repaid to the person paying the same out of the Condemnation Fund
of the City Treasury of the City of Salina upon due proof being furn-
ished to the Board of Commissioners of such payment.
