RESOLUTION NUMBER 1381
WHEREAS, WM. GARRISON is the owner of..Lots Two (2) and Four (4)
Block Six (6), Sunnyside Addition to the City of Salina, -Saline County,
Kansas; and
WHEREAS,said lots are duly zoned under the subsisting zoning
ordinances of the City of Salina, Kansas, as a part of District "B't as in
said subsisting zoning ordinances made and provided and as amended; and
WHEREAS, said owner did file an application for a building permit
authorizing the installation of three family units in a structure thereon
situate; and
WHEREAS., said building permit was duly refused by the Building
Inspector of -the City of Salina, Kansas.; and
WHEREAS, said owner did appeal tothe Board of Zoning Appeals as
made and provided inlaid subsisting zoning ordinances; and
WHEREAS, on the hearing of said appeal,said owner did request
the authorization of the installation of an additional dwelling unit in
said structure on the theory that such variance of the terms of said sub-
sisting zoning ordinances would not be contrary to the public interest
due tothe area in which it is situate and the proximity of three dwelling
unit structures in the area for the further reason that a literal enforce-
ment of the provisions of s aid subsisting ordinances would result in unneces
sary hardship and that the spirit of said ordinances would be observed
and substantial justice done by the Board of Zoning Appeals, authorizing
the use of three dwelling units within the structure situate on the lands
aforesaid; and
WHEREAS,said board did cause notice of hearingto be duly pub-
lished; tobs had and held by the Board of Zoning Appeals February 16,
1953, at 8:50 o'clock P. M. of said day; and
WHEREAS;, said hearing was duly held; and
SO, NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF ZONING APPEALS
of s aid city, that:
That said board hereby determines that the use of three dwelling
units on the lands aforesaid should be and it is hereby authorized, subject
to the limitations and conditions hereof, and that a literal enforcement
of the provisions of the subsisting zoning ordinances of said city, as
amended, would result in unnecessary hardship and the variance herein
authorized is within the spirit of said ordinances, and that such variance
will result in the doing of substantial justice, provided, however, that
the continuance of said use is hereby made absolutely contingent upon the
present and future owners of the land aforesaid, maintaining thereon at
a place available to the public streets thereabou , an all-weather parking
area for not less than three motor vehicles, and that such area shall be
continuously maintained a s such a parking area and shall continusously be
made available for the use of the person or persons inhabiting the structure
so situate; -and that in the event of the owner of s aid lands failing or
neglecting to provide such an area and to cintinusously maintain the same
fors aid purpose, that thereupon the lands aforesaid shall forthwith revert
to the uses authorized in District "BIP as in the subsisting zoning ordinance
of said city made and provided.
