ORDINANCE NUMBER 09-10519
AN ORDINANCE PROVIDING FOR THE ANNEXATION OF CERTAIN TRACT OF
LAND IN SALINE COUNTY, KANSAS IN CONFORMITY WITH THE PROVISIONS OF
K.S.A. 12-520(f).
WHEREAS, pursuant to K. S.A. 12-520(f) notification has been received from the Saline County
Commission of a highway (South Ninth Street) that has a common boundary with the City of Salina but
has not become part of the city; and
WHEREAS, pursuant to K.S.A. 12-520(f) the Saline County Commission has formally requested
that a portion of this highway (South Ninth Street) abutting the existing city limits be declared annexed
into the city; and
WHEREAS, pursuant to K.S.A. 12-520(f) the legal description of the highway right-of-way has
been reviewed by the city and found to accurately describe the highway right-of-way the County is
requesting be annexed. SO, NOW THEREFORE,
BE IT ORDAINED by the Governing Body of the City of Salina, Kansas:
Section 1. That the following described tract of land, to -wit:
Part of Sections 1 and 2, Township 15 South, Range 3 West
Beginning at the intersection of the east right of way of South Ninth Street and the south line
of the North Half of the Northwest Quarter of Section 1, Township 15 South, Range 3 West;
thence N 89'07'34"W along said south line a distance of 149.3 feet to the southwest corner of
said North Half; thence N 89°56'29"W a distance of 61.92 feet to a point on the west right of
way line of South Ninth Street; thence S 0°05'43"W along the west right of way line of South
Ninth Street, a distance of 3932.64 feet to a point 35.00 feet north of the south line of Section
2, Township 15 South, Range 3 West; thence S 89°57'20"E a distance of 140.3 feet to a point
on the east right of way of South Ninth Street and the north right of way line of Water Well
Road; thence N 0'05'32"E along the east right-of-way line of South Ninth Street, a distance of
1118.56 feet; thence N 5044'25"E continuing along said east right of way line of South Ninth
Street, a distance of 722.7 feet; thence N 0005'32"E continuing along said east right of way of
South Ninth Street, a distance of 2092.77 feet to the point of beginning.
The described tract contains 16.661 acres, more or less.
meeting the criteria for annexation set out in K.S.A. 12-520(f) is hereby annexed and made a part of the
City of Salina, Kansas.
Section 2. That this ordinance shall be in full force and effect from and after its adoption and
publication once in the official city newspaper.
