A RESOLUTION relating to the authorization of non-compliance with the
requirements of Ordinance Number 5549, or the construction of a steel
fire escaps at their Freight Office on North.Third Street., Original Town -
site, City of Salina, Saline County, Kansas.
WHEREAS, Union. Pacific Railroad Company of . Salina, Kansas, did apply for a
certain building permit relating to the constructionof a steel fire
escape at their Freight Office on North Third..Streat, Original Townsite,
City of Salina, Saline. County, Kansas.
WHEREAS., the. Building. Inspector . of the - City City of Salina, Kansas., did_ refuse
to. grantsaid permit for. the. r.eason of non-compliance with the requirements
of Ordinance Number 5519; and
BAR',_ Union Pacific...Railroad..Cortgaany__did. appeal-.- such. refusal to the
Board of Zoning Appeals.- of_ the City. of_ baling, . Kansas, and have a. hearing
relating thereto; and
WHEREAS, said Board did order that.a hearing.be.had on said appeal and did
direct that no ice be duly published informing the .public that said hearing
would be held;. and
WHEREAS, said .notice was duly published and.no persons appeared to .protest
the variance.
SO NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF COMMISSIONERS OF THE CITY
OF SALINA, KANSAS: That Union Pacific Railroad Company should be and is
hereby authorized to construct a. steel fire escape..at._.their Freight Office
on North Third Street, Original Toransite., City of Salina, Saline County,
Kansas, and that the requirements are waived, onthe above mentioned proper-
ty, and that such variance is hereby determined to not be contrary to the
public interest and that substantial justice.. will.. be done by such aathorAsed
variance, and that such authorized variance and..that such authori.zation.is
consistent with the intent and purposes of the Zoning_Ordinance.of the City
of Salina, Kansas.
