1768 Issue Temporary Notes PT-23182
RESOLUTION NUMBER 1768
A RESOLUTION authorizing and providing for the issuance of Temporary Note
of the City of Salina, Kansas, in the sum of $64,640.10 to pay a portion
of the cost of improving certain streets in the City of Salina to a designat
as Series PT -23 pending t e issuance of bonds to pay the cost of said work.
WHEREAS, Pursuant to proceedings duly had according to law, contracts have
brrn let and partially performed for the construction of certain street
improvementsin the City of Salina, Kansas, as provided by Resolution Numbers
1716, 1712, 1686, 1670, 1671, 1693, 1666, 1667, 1652, 1658, 1657, 1681, 1692 ,
1694 and-. and Ordinance Numbers 6078 and 6084, all of which resolutions and
ordinances are incorporated herein by reference as fully as though set out
here in full; and
WHEREAS, the total estiated cost of said improvements is $189,629.00 and
WHEREAS, temporary note Number 1 has heretofore been authorized registerered
and issuedtin the sum total of $29,919.58; and
WHEREAS;, approved Estimate -Number 3 is now on file in the office of the City
Clerk establishing that the 0. D. Wilmoth Construction Company contractor,
has partially performed the construction or contract thereof, and is entit-
led to receive the sum of $64,640.10 for such partial performance; and
WHERE, Pending t e issuance and sale of bonds to pay to cost of said
improvements it is necessary for said City to issue its temporary note to
acquire funds to pay said contractor for such work; and SO NOW', THEREFORE,,
BE IT RESOLVED by the Board of Commissioners of the City of Silidi , Kansas;:
That the foregoing preambles are hereby made a part oft h is resolution.
That pending the issuance and sale of bonds to pay t e cost of said improve-
ments, the City o£DSalinashall issue its temporary note, date November 6th,
1956 , bearing interest at a rate not exceeding six'per cent per annum,
maturing not later than December 1, 1957, in the sum of $64,640.10, being a
sum less than the aggregate -.amount of bonds to be and now unissued, as sup-
ported and shown by the approved estin.tes now on f ile.and in denomination
as follows:

That said temporary note s.hall.be signed by the Mayor and shall be
attested by the signature of the City Clerk and the corporateseal of. the
City shallbe affixed thereto and thatsaid.temporary note shall.b a regis-
tered in the office of the City Clerk and in the foocie of the State Auditor
as required by law.
That said note shallbe designated as Series PT -23 and same shallbe in
the form and contain recitals substantially as follows, to -wit:

KNOW ALL MEN BY THESE PRESENTS, That the City of Salina in the County of Saline,
State of Kansas, acknowledges itself to be indebted and for value received
promises to pay the bearer the sum of
_DOLLARS,
in lawful money of the United States of America, on the first day of
19 ,.with interest thereon from the date thereof at the rate of
per cent per annum, payable at maturity thereof, both principal and
interest of this note being -payable at the office of the State Treasurer of the
State of Kans4* in the City of Topeka, and the full faith, credit and resources
of said City are hereby irrevocably pledged for the payment of said principal
and interest at maturity.
This note is one of a'series of _notes of like date and tenor, excepting
denomination, aggregating to principal sum of ,
issued by the City of Salim , Kansas, for the purpose of paying a part of the
cost of construction of certain curbing, guttering, paving and grading improve-
ments in said city by the aut ority of and in full compliance with the pro-
visions, restrictions and limitations of the constitution and laws of the State
of Kansas, including Sectioxm 10-101 to 10-115, 12-601 to 12-608 and 13-1011,
13-1011A and 10-123 General Statutes of Kansas%, 1949, and such sections as
amended and all other provisions of Vie laws of said state -,applicable thereto,
and this note and interest to be paid by the City of Salina, Kansas.
And it is hereby declared and certified that all acts, conditions and things
required to be done and to exist precedent to and in t e issuance of this note
have been.properly done and performed and to exist in due and regular form and
manner as required by the constitution and laws of the State of Kansas, and that
the total..indebteduess of said City, includin this series of notesm does not
exceed constitutional -or statutory limitations.
IN WITNESS WHEREOF, the City of Salina, Kansas, has executed this note by
causing it to be signed by its Mayor and its corporate seal to be affixed there-

That the Mayor and City Clerk are hereby authorized to and directed
to prepare and execute said note and to sell the same in the manner providedi
by law,, and when duly executed and registered to deliver said note to the
purchaser or purchasers thereof.
That this resolution be in full force acid effect from and after its
adoption.
