RESOLUTION NUMBER 1720
A RESOLUTION relating to the authorization of non -co nc a with Side
Yard Requirements on East Side,,of Ordinance Number1afor Lot the
9th
Street in Grounds of Kansas Wesleyan University Addition to the City of
Salina, Saline County, Kansas.
WHEREAS, A. A. Riker of Salina, Kansas, dia plly for a certain building
permit relating to the utilization of Lot 66, on 9th Street in Grounds of
Kansas Wesleyan University Addition to the City of Salina, Saline County,
Kansas.
W fftEASy The Building Inspectmr of the City of Salina, Kansas, did refuse
grant said permit for the reason of non-compliance with the Side Yard Re-
quirements on East Side of Ordinance Number 5519 of said City; and
WHMEAS, A: A. Riker did appeal from such refusal to the Board of Zoning
Appeals of the City of Salina, Kansas, and have a hearing relating thereto;
and
WHWIM% said Board did order that a hearing 'be had ons aid appeal and dial
direct that notice be duly published informing the public that said hearing
would be held; and
WHMEAS� said Notice was duly published aid no persons 'appeared to protest
the variance from the requisites of said section of said ordinance; and
SO NOW, TtiE WORE, BE IT RESOLVEDb)rhthe Board of Commissioners of the City
of Salina, Kansas, that A. A. Riker should be and is hereby authorized to
utilize the full area of -the lot describedas aforesaid for the purpose of
constructing and installing thereon facilities for his use in his program to
the extent that the Side Yard Requirements on East Side are waivecy on the
above mentioned property, and that such variance is hereby determined to
not be contrary to the public interest and that substantial justice will
be done by such authorized variance, and that such authorization is con-
sistent with the intentand purpose of the Zoning Ordinance of the City of
Salina, Kansas.
