RESOLUTION NUMBER 1688
A RESOLUTION relating to the authorization of non-compliance with the
Side and Front Yard Requiremert s of Section 8 and 9, District "C" of
Ordinance Number 5549 for West 70 feet of Lot 103, 105 and 107 on Second
Street in Original Town of the City of Salina, Saline County, Kansas.
WHEREAS, Paul B.. Adrian of Salina, Kansas did apply for a certain building
permit relating to the utilization of the West 70 feet of Lot 103,,105 and
107 on Secord Street in Original Town of the City of Salina, Saline County,
Kansas.
WH +' The Building Inspector of the City of Salinas Kansas, did refuse to
grant said permit for the reason of non-compliance with the Side and Front
Yard Requirements of Section 8 and 9, District "C" of Ordinance Number.5549
of said City; and
WHEREAS, Paul B.Adrian did appeal from s}rch refusal to the Board of Zoning
Appeals of the City of Salina, Kansas, and have a hearing relating thereto;
and
WHEREAS, Said Board did order that a hearing be had on said appeal and did
direct that notice be duly published informing the public that said hearing
would be held; and
WHEREAS.- said Notice was duly published and no persons appeared to protest
the variance from the requisites of said section of said ordinance; and
SO, NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF COICSSIONERS OF THE CITY
OF SALINA, KANSAS;, that Paul B. Adrian should be and is hereby authorized
to utilize the full area of the lot described as aforesaid for the purpose
of constructing and installing thereon facilities for his use in his program
to the extent that the Side and Front Yard Requirements are waived on the
above mentioned property, and that such variance is hereby determined to
not be contrary to the public interest and that substantial justice will be
done by such authorized variance, and that such authorization is consistent
with the intent and purposes of the Zoning Ordinances of the (Ity of Salinap
Kansas.
