A RESOLUTION relating th the authorization of non-compliance with front
yard requirement, Section 17, Paragraph 8 and 11 of Ordinance Number 5549
for Lot One (1) on Sherman-8#eet, Dimicks Addition to the City of Salina,
Saline County, Kansas.
WHEREAS, George Lantz of Salina, Kansas did apply for a certain building
permit relating to the utilization of Lot One (1) on Sherman Street, Dim-
icks Addition to the City of Salina, Saline County, Kansas.
WHEREAS:, the Building Inspector of the City of Safina, Kansas, did refuse
to grant said permit for the reason that insufficient yard space was avail-
able under the requisites of Front Yard Requirement, of Ordinance No. 5549,
Section 17 Paragraph 8 and 11 of said City; and
WHEREAS, George Lantz did appeal from such refusal to the Board of Zoning
Appeals of the City of Salina, Kansas, and have a hearing relating there-
to; and
WHEREAS, Said Board did order that a hearing be had onsaid appeal and
did direct that notice be duly published informing the public that said
hearing would be held; and
WHEREAS, said Notice was duly published and no persons appeared to protest
the variance from the requisites of s aid section of said ordinance; and
SO, NOW THEREFORE, BE IT RESOLVED by the Board of Commissioners of the
City of Salina, Kansas, that G orge Lantz should be and is hereby authorized
to utilize the full area of th@e lot described as aforesaid for the purpose'
of constructing and installing thereon facilities for their use in their
program to the extent that the ste back requirements are waived on the above
meAtibnedd grope rty, and that such variance is hereby determined to not be
contrary to the public interest and that substantial justice will be done by
such authorized variance, and that such authorization is°consistent with
the intent and purposes of the zoning ordinances of the City of Salina, Kan-
sas*
