RESOLUTION NUHM 1632
(Published in the Salina Journal November 1955).
A RESOLUTION determining the necessity of and directing that the owner
or owners of ce tain lots construct, in compliance with plans and
specifications of the City Engineer, a sidewalk abutting said lot,
'thin 30 days of the adoption and publication hereof and providing
that in the event the owner or owners fail to do so, that the City
of Salina shall proceed to construct or cause to ,be constructed said
sidewalk and that the total cost thereof shall be assessed against
such lot or lots on which such sidewalk shall abut as other special
assessments.
1k,REAS, a sufficient petition has heretofore been filed praying
for the construction of certain sidewalks hereinafter described; and now
BE IT RESOLVED by the Board of Commissioners of the City of Salina, Kansas
That a didewalk five (5) feet in width shall be constructed in
accordance with the accepted and approved standard plans and specifications
of the City Engineer of said City now on file in the office of said engineer,
whicharehereby incorporated herein, in the west parking of the 5buth
Fifth Street, in said city and abutting Lot 2, Block 1, Replat of Beebe ' s
Secon Addition to City of Salina, Kansas, ins aid City and the construc-
tion thereof is hereby determined to be a necessary improvement.
That the owner or owners of each of said lots described in the pre-
ceding paragraph hereof are hereby directed to cause said sidewalk to be
so constructed immediately adjacent to their respective lot or lots within
thirty days from and after the publication hereof, and in compliance with
said plans and specifications, and in the event of the failure of any
owner or owners of said lots so to do, then the Board of Co mmi.ssioners of
the City of Salina, Kansas, shall proceed to constructs aid sidewalk or cause
the same to be constructed at the place or places where such owner or owners
have so failed., and that said Board shall cause the cost thereof to be
assessed against the lot or lots on which said sidewalk abuts as a special
assessment and that the City Clerk of the City of Salina shall c ause said
special assessment to be certified to the County Clerk of Jaline County,
Kansas, tobe collected acdording to law.
This resolution shall be in full force and effect from and after its
adoption and publication once in the official City paper.
