2184 Side Yard Variance10 F A RESOLUTION relating to he authorization of non-compliance wit# the Side Yard Requirements of Ordinance Number 550 for Lot 12,on Kirwin Avenue, Grounds of Kansas Wesleyan University Addition to the City of Salina, Saline County, Kansas. WHMEAS., Lloyd Gray of Salina, Kansas, did apply for a certain building permit relating tothe utilization of Lot 12 on Kiriwn Avenue, Grounds of Kansas Wesleyan University Addition to the City of Salina, Saline County, Kansas. WHERMI p the Building Ins pector of t he City of Salina,xansag , did refuse to grant said permit for thereason that non-compliance with the Side Yard Requirements of Ordinance Number 5549 of said City, and WHERE, Lloyd Gray, did appeal from such refusal tothe Board of Zoning Appeals of the City of Salina, K ansas, and have a hearing relating hereto; and WIC, said Board did order that a hearing be had onsaid appeal and did direct that notice be duly published informing the public that said hearing would be held; and WHEREAS,said notice was duly published and no persons appeared to protest the variance from the requisites of said Section of said Ordinalos., and SO, NOW THEREFORE: BE IT RESOLVED by the Board of Commissiosrs of the City of Salinapymsas: That Lloyd Gray should be and is hereby authorized to utilize the full area of the lot described as aforesaid for the purpose of constructing and installing thereon facilities for his use in his program to the extent that the Side Yard Requirements are waived on the above mentioned property, and that such variance is hereby determined to not be contrary to the public interest and that substantial justice will be.done by such.authorized variance, and that such authorization is consistent with the intent and purposes of the Zoning Ordinance of the City of Salina, Kansas.
