RESOLUTION NUMBER 2147
A Resolution authorizing and ordering certain street, sanitary sewers,
and sidewalk improvements, ordering preparation of plans and specifications,
and the estimate of costs.
WHWAS?, the public hearing on the advisability of the following
improvements, to -wit:
A. (a) Curb, gutter, grading and paving with six.(6) inch
reinforced concrete , Queens Road, Claremont Drive, Camden
Drive, Lynwood Drive and Regeant Road, all in Claremont
Heights Addition, Salina, Saline County, Kansas.
(b) Sanitary sewers and Sidewalks to serve all of Block 2,
except Lots 1 and 2, all of Blocks 3, 4, 5A 6, 7 and 8,
all inClaremont Heights Addition, Salina, Daline County,
Kansas.
was held as provided by Resolution Number'2124 adopted and approved by the
Board of Commissioners of the City of Salina, Kansas, on the 3rd day of March,
1959;
.WHEREAS`, notice of public hearing on the advisability of the said
improvements has been published in the Salina Journal, t e official city
newspaper on the 11th and 18th days of March 1959, as,provided by said
Resolution, and Section 4, Chapter 99, Session Laws of 1957.. State of Kansas.
WHEREAS, the Board of Commissioners of the City of Salina, Kansas, met
in the Commissioners Room at the City Hall on the Twenty -Fourth day of March,
1959, at 4:00 P. M. for the purpose of conducting a public hearing on the
advisability of said improvements, s aid hearings were finally adjourned
on the Twenty -Fourth day of March 1959, all as provided by law.
WHEREAS, sic (6) months have not elapsed since the final adjournment of
said public hewing.
NOW, THEREFORE;, BE ITRESOLVEp BY THE BOARD OF COMMISS ONERS OF THE CITY
OF SALINA, KANSAS:
Section 1.
A. That the following improvement be and the same is hereeby
authorized and ordered to be made in accordance with the findings of the
Board of Commissioners of the City of Salina, K ansas, upon the advisability
of the improvements, to wit:
(a) Curb, gutter, grading and paving with six (6) inch reinforced
concrete, Queens Road, Claremont Drive, Camden Drive, -Lynwood
Drive and Regeant Road, all in Claremont Heights Addition,
Salina, Saline County, Kansas.
(b) Sanitary Sewers and Sidewalks to serve all of Block 2, except
Lots 1 and 2, all of Blocks 3, 4, 5,_ 6, 7 and 8, all in
Claremont Heights Addition, Salina, Saline County, Kansas.
B. The estimated or probable cost of such improvements is
$177,859.13•
C. The extent or boundaries of the proposed improvemen district
to be assessed is:
That part of the City of Salim , Saline County, Kansas, described
as follows, to wit:
All in Claremont Addition, City of Salina, Kansas;, described as
follows:
(1) Beginning at the northeas t corner of Lot 3, Block 2, Claremont
Addition;
(2) Thence south along west line of said Claremont Addition to the
southwest corner thereof;
(3) Thence east along the south line of said Claremont Addition to
the west line of Marymount Road;

Thence north along the west line of Marymount Road to the north
line of Queens Road;
(5)
thence west along the north line of Queens Road 60.0 feet;
(6)
Thence north 60.0 feet from and parallel to Regeant Road to
the south line of Ruskin Road;

Thence west along the south line of Ruskin Road to a point 40.0
feet west of the west line of Regeant Road;
(8)
Thence south 62.25 feet;
(9)
Thence west, parallel to and 62.25 feet south of the south line of
Ruskin Road to the west line of Lot 3, Block 4 ins aid Claremont
Addition;
(10)
Thence northwesterly to a point on the west line of Lot 2, Block 4,
in said Claremont Addition, which point is 50.0 feet south of the
south line of Ruskin Road.
(11)
Thence w est, parallel to and 50.0 feet south of Ruskin Road
a distance of 50.0 feet;
(12)
Thence north•50.0 feet to the south line of Ruskin Road;
(13)
Thence w est along the south line of Ruskin Road to a point
45.0 feet west of Camden Drive;
(14)
Thence south 50.0 feet;
(15)
Thence west 50.0 feet south and parallel to the south line
of Ruskin Road 245.0 feet;
(16).
Thence.north 50.0 feet to the south line of Ruskin Road;
(17)
Thence west following the south line of Ruskin Road and
the extension thereof to the northeast corner of Lot 3s Block .

Thence west along the north line of said Lot 3, Block 2,.
of Claremont Addition 180 feet, more or less, to the
point of beginning.
D.
The apportionmeit of cost between the improvement district and
the
City at large is as follows:
(a) City at large to pay for paving of intersection .
(b) City at large to pay for all excavation to bring streets to grade.
(c) City Water Department to lay water main, including all valves,
hydrants and circulation mains.
(d) City at large to pay for storm sewers and appurtenances.
(e) City at large to pay for sidewalks in intersection.
E.
Method of assessment shall be:
(a) Private property to pay for concrete paving except inter-
sections of street s.
(b) Private property to pay for excavation the thickness of the
paving.
(c) Private propetty to pay for all costs of sanitary sewers,
including manholes, lampholes, and stub -outs under pavement.
(d) Private property to pay $1.50 per front foot for each lot or
parcel for water main.
(e) Private property to pay for stub -outs under pavement for water
services.
(f) Private property to pay for concrete sidewalks except that
placed,in the intersections of streets.
(g) Method of assessment shall be on the square foot basis.
The assessments against each lot, piece or parcel of land
shall be made in direct proportion to its fraction of the
total area of property deemed benefited.
F. The assessment with accrued interest, shall b e levied as a
special tax upon the property included therein concurrent with general
property taxes and shall be payable in twenty (20) equal annual instamm-
ments.
Section 2.
That the City Engineer be, and he is hereby directed and ordered
to prepare plans and specifications, and estimates of the cost of said im-
provements by the 5th -day of May 1959•
Section 3.
That the said improvements shall not be commenced if within
twenty (20) days after the publication of the Resolution, written prsts
by both fifty-one per cent (51%) or more of the resident owners of record
of proper ty within the improvement district and the owners of record or
more than one-half of the total area of such district, are filed with the
City Clerk.
Adopted and approved by the Board of Commissioners of the City o
Salina, Kansas, in regular session, this 21st day of April 1959.
