RESOLUTION NUMBER 1990
WHEREAS3 the City of Salina is duly proceeding with certain
flood control improvements in conjunction -with the Federal govern -
meat through the United States Army Corps of Engineers; and
WHEREAS, the Socory-Mobil Oil Company, Inc., is the owner of
certain easements and oil gathering facilities located in the North-
East Quarter (NEJ) of Section 30, T -14-S, R -2-W., and in the Northeast
Quarter (NE -41) of Section 18, T-14-8, r -2-W., which oil gathering facili-
ties constitute an obstruction to the construction of said flood control
works; and
WHEREAS, the City Engineer is advised that it is necessary in the
performance of said construction work and in the interests of public -
safety to require certain changes in said pipelines and oil gathering
facilities, including relocation and replacement of said lines, and that
said changes can be most economically made by the owner of said facilities,
the Socony-Mobil Oil Company,Inc.,; and,
WHEREAS, in accordance therewith, an agreement with said Socony-Mobil
Oil Company,Inc. has been proposed and entered into by said company and
the City of Salina, which agreement supersedes any and all other agree-
ments heretofore entered into between the parties and which agreement is
attached hereto and made a part hereof; and,
WHEREAS, itwould be for the best interests of said City to approve
said agreement and to have the same e3ecuted as provided by law;
NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the
City of Salina, Kansas:
SECTION 1. That the agreement with Socony Mobil Oil Company, Inc.
dated April 15, 1958, providing for the accomplishment of changes and
relocations of certain oil gathering facilities and the reimbursement
for crude oil hauling during necessary period of deactivation of pipelines
made necessary by the flood control project construction, all in accord-
ance with the terms and provisions of the agreement attached hereto and
made a part herepf, be and the same is hereby approved.
SECTION,2. That the said agreement shall be signed by the Mayor
and attested by the City Clerk and the se-il of the City of Salina, Kansas.,
be affixed thereto.
