RESOLUTION NUMBER 2413
RESOLUTION relating to the authorization of non-compliance with the Rear Yard
Requirements of Ordinance Number 5549 for East One Half of Lots 1 and 2 in
Block 10, Riverside Park Addition in the City of Salina, Saline County, Kansas.
WHEREAS, Ralph A. Hartzell, of Salina, Kansas, did apply for a certain building
permit relating to the utilization of the East One half of Lots 1 and 2 in
Block 10, Riverside Park Addition in the.City of Salina, Saline County, Kansas.
WHEREAS, the Building Inspector of the City of Salina, Kansas,, did refuse to
grant said permit for the reason that non-compliance with the Rear Yard
Requirements of Ordinance Number 5549 of said City, and
WHEREAS, Ralph A. Hartzell, did appeal from such refusal to the Board of Zoning
Appeals of the City of Salina, Kansas, and have a hearing relating thereof; and
WHEREAS; said Board did order that a hearing be had on said appeal and did
direct that notice be duly published informing the public that said hearing would
be held; and
WHEREAS, SAID notice was duly published and no persons appeared to protest the
variance from the requisites of said Ordinance, and SO NOW, THEREFORE
BE IT RESOLVED by the Board of Commissioners -of the City of Salina, Kansas:
That Ralph A. Hartzell, should be.and is hereby authorized to utilize the full
area of the lot described as aforesaid for the purpose of constructing and
installing thereof facilities for his use in his program to the extent that the
Rear Yard Requirements are waived on the above mentioned property, and that
such variance is hereby determined to.not be contrary to.. -the pullic-interest..
and that substantial justice:!will.be done by such authorized.variance,-and that
such authorization is.consistent with the.intent and purposes_of.the-.Zoning
Ordinance ofdthe City of Salina, Kansas.
