RESOLUTION NUMBER 2325
WHEREAS, the City of Salina, Kansas, has heretofore by resolution duly
passed and declared it necessary for the public good and convenience that the
City of Salina be protected from the overflow of certain watercourses, namely
Smoky Hill River and Dry Creek; and,
WHEREAS, a competent engineer has made a survey and a full and complete
plan of protecting the City of Salina from the overflow or damage by water of
said watercourses, said estimate and report by the engineer being in compliance
with the G. S. 1949, 12-636 and supplements and amendments thereto; and,
WHEREAS, the State Corporation Commission of the State of Kansas has duly
entered its order approving the application of the City of Salina, Kansas, for
approval of its report,. plans, specifications and cost estimate for the prpposed
flood protection improvements and flood controlproject; and,
WHEREAS, the Chief Epgineer of the Division of Water Resources of the
Kansas State Board of Agriculture has duly approved the pians and specifications
for said flood control project and protection program submitted by the City of
Salina, Kansas, in accordance with G. S. 1949, 12-637, and the supplements and
amendments thereto; and,
WHEREAS, the City of Salina, Kansas, in accordance with G. S. 1949, 12-635
and the supplements and amendments thereto, has acquired and is acquiring by
gift or purchase and by eminent domain pursuant to Article 2 of Chapter 26 of the
General Statutes of 1935 and acts amendatory thereof and supplemental thereto,
the land, permits, rights, easements, etc. necessary to construct the Salina
Flood Protection and flood control system; and,
WHEREAS, G. S. 1949, 12-639, provides that the governing body shall appoint
three disinterested householders of said City to assess all damages to any and
all property that will be injured or damaged by reason of said improvement which
property has not been heretofore included in eminent domain proceedings by the
City of Salina or heretofore acquired pursuant to G. S. 1949, 12-635;
NOW, THEREBOR., BE IT RESOLVED BY THE BOARD OF COMMISSIONERS OF THE CITY OF
SALINA, KANSAS:
Section 1. That the following three disinterested householders of the City
Salina, Kansas:
Ira Huntington
Norman Grant
Berkley Greiner
be and they are hereby appointed as appraisers to assess all damage to any and
all property (other than that heretofore acquired by the City of Salina pursuant
to G. S. 1949, 12-635) that will be injured or damaged by reason of the
improvement known as the Salina Flood Control Project.
Section 2. In fixing the amount of injury or damage to any property said
appraisers shall take into consideration the benefit, if any, that said property
will receive by virtue of said improvements and if the benefit received shall
be equal to or greater than the damage or injury to said property, then in that
event no damage shall be allowed.
Section 3. Said appraisers, before entering upon their duties as such,
shall first take and subscribe an oath to faithfully perform their duties as
such appraisers and shall personally view, inspect and examine all lots and
pieces of ground, the buildings thereon, rights of way, read beds, bridges,
culverts, depot grounds, grades, streets, railway, telephone and telegraph
property, and all other property liable to be injured or damaged by reason of
said improvements being made.
Section 4. Said appraisers,shall, after performing their duties in
accordance with law, file their written report with the City Clerk of the City
of Salina, Kansas.
Section 5. Said appraisers shall be entitled to receive for their services
reasonable compensation.
THIS RESOLUTION approved and adopted this 19th day of April 1960.
