RESOLUTION NUMBER 2278
A RESOLUTION relating tothe authorization.of..non-compliance.-with the
Front Yard Requirements _.of_ .Or __dinance_. Number 5549 for Lot 3, plus the
Ea mt 4 feet of Lot 4 and the West 2 feet of_. Lot 2 of Vanderbilt Addition ,
to the City of Salina, Saline County, Kansas.
WHEREAT, Phillip Humbargar of Salina, Kansas, did apply for a certain
building permit relating to the utilization of Lot 3, plus the East 4 feet
of Lot 4 and the West 2 feet of Lot' 2, Vanderbilt Addition, to the City
of Salina, Saline County, Kansas.
WHEREAS, the Building Inspector of the City of Salina, Kansas, did refuse to
grant said permit for the reason that non-compliance with the Front Yard
Requirements of Ordinance Number 5549 of said City, and
WHEREAS;, Phillip Humbargar, did appeal from such refusal to the Board of
Zoning Appeals of the City of.Salina, Kansas, and have a hearing relating
thereto; and
WHEREAS, said Board did order that a hearing be had on said appeal and did
direct that notice be duly published informing the public that said hearing
would be held; and
WHEREAS),s aid no ice was duly published and no persons appeared to protest
the variance from the requisites of said Ordinance, and SO NOW, THEREFORE
BE IT RESOLVED by the Board of Commissioners of the City of Salina, Kansas:
That Phillip Humbargar should be and is here by authorized to utilize the
full area. of the lot described as aforesaid for the purpose of constructin
and istalling thereon facilities for his use in his program to the event
that the Front Yard.Requirements are waived onthe above mentioned property,
and that such variance is hereby determined to not be contrary to the public,
interest and that substantial justice willbe done by such authorized variance,
and that such authorization is consistent w ith the intent and purposes of
the Zoning Ordinance of the City of Salina, Kansas.
