A RESOLUTION relating to the. authorization.of...non-compliance with the
Insuff icient Side Yard Requirements of Ordinance Number 5549 for Lot 39,
on East Jewell, Grounds of Kansas Wesleyan Univer sity to the City of
Salina, Saline County, Kansas.
WHEREAS, Altman Construction and Supply of Salina, Kansas, did apply for
a cer tain building permit relating tothe utilization of Lot 39 on East
Jewell, Grounds of Kansas Wesleyan Univer mity, to the City of Salina,
Saline County, Kansaa.,
WHERE&% the Building Inspector of the City of Salina, Kansas, did refuse
to .grant said per mit for t he r easob that non-compliance with the Insuf-
ficient Side Yard Requirements of Ordinance Number 5549 of said City, and
WHEREAS, Altman Constr uction and Supply, did appeal from such refusal to
the Board of Zoning Appeals of the City of Salina, Kansas, and have a hear-
ing relating thereto; and
WHEREA4 said Board did order that a hearing be. had on said' appeal and
did direct that notice be duly -published informing the public that said
hearing would be held;*and
WHEREAS, said notice wasduly published and no persons appeared to protest
the variance from the requisites of said Ordinace, and S0, NOW THEREFORE:
BE IT RESOLVED by the Board of Commissioners of the City of Salina, Kansas:
That Altman Constr uction and Supply should be and is here by authorized to
utilize the full area of the lot described as aforesaid for the purpose
of constructing and installing ' thereon facilities for his use -in his program
to the extent that the Insufficient Side Yard Requirements are waived on
the above mentioned property, and that such variance is hereby determined
to not be contrary to the public interest and that substantial justice
will be done by such authorized variance, and that such authorization is
consistent with the intent and purposes of the Zoning Ordinance.of the City
of Salina, Kansas.
