A RESOLUTION relating tothe authorization. of non. -compliance with the Side -Yard
Requirements of Ordinance Number 5519 for Lot 8, Block'12,, Beverly Manor Addi-
tion to.the City of Salina, Saline County, Kansas.
WHEREAS, Mrs. A. J. Hauptli of Salina, Kansas;, did apply for a certain building
permit relating to the..utilization of Lot 8, Block 2, Beverly Manor Addition
to the City.of Salina, Saline County, Kansas.
WHEREAS, the Building Inspector of the City of Salina, Kansas;, did refuse
to grant said permit for the reason that non-compliance with the Side -Yard
Requirements of Ordinance Number 5549 of said City, and
WHEREAS, Mrs. A. J. Hauptli did appeal to the Board of Zoning Appeals of
the City . of Salina, Kansas, from such refusal, and have a hearing, relating
thereto; and
WHEREAS, said Board did order that a hearing be had onasaidcappeal and did
direct that notice be duly published informing .the public that said hear ing
would be held ; and
WHEREAS',.said notice was duly published and no persons appeared to protest
the variance from the re quisites ofsaid Ordinance, and SO, NOW THEREFORE:
BE IT RESOLVED by the Board of Commission rs of the City of Salina, Kansas:
That Mrs. A. J. Hauptli should be and is hereby authorized to utilize the full)
area of the lot described as aforesaid for the purpose of constr ucting and
installing there on facilities for her use in her program to the extent that
the Side -Yard Requirements are waived on the above mentioned property, and
that such variance is hereby determined to no be contrary to the -public
interest.and that substantial justice will be done by such authorized variance
and that s uch authorization is consistent with the intent and purposes of
the Zonin OTdinace of the City of Salina, Kansas.
