the 60 foot vacated Charles Street, South Park -Addition and the North 51
feet of Lot 5, Block 6, South Park Addition to.the_,City of Salina, Saline
County, Kansas.
WHEREA a, J. Earl Wyatt of. Salina,. Kansas. did apply for a certain building
permit relating to the. utilization. of the. South 58 feet of the 60 foot vacate
Charles Street, South Park Addition_ _and the. North. 51 feet of Lot 5, Block 6,
South Park Addition to the City.of_Salina, Saline County, Kansas;
WHEREAS, the Building Inspector of. the City of Salina, Kansas, did reuse
to grant said permit for the reason that non-compliance with the Lot Frontage
Requirements of Ordinal ce Number 55119 of said City, and
WHEREAS, J. Earl Wyatt, did appeal from such refusal to the Board of Zoning
Appeals of the City of Salina, Kansas, and have a hearing relating thereto ;
and
WHEREAS, said Board did order that a hearing be had on said appeal and did
direct that notice be duly published informing the public that said hearing
would be held; and
WHEREAS, said notice was duly published and no persons appeared to protest
the variance from the requisites of said Ordinance, and SO, NOW THEREFORE:
BE IT RESOLVED by the Board of Commissiorers of the City of Salina, Kansas:
That J.Earl Wyatt should.be and..is hereby authorized to utilize the full
area of the lot described -as aforesaid for the purpose. of constructing and
installing thereon facilities..for..his_use in his program to the extent that
the lot frontage requirements are waived on the above mentioned property,
and that such variance is hereby determined to not be contrary.to the public
interest and that substantial..justice will be.done by such authorized
variance, and -that such.aut..oriaation.is consistent with the intent and
purposes.. of. the Zoning Ordinance of. the City of Salina, Kansas.
