2196 Authorize Improvements Shalimar Plaza AdditionL i 1 17 RESOLUTION NUMBER -W6 A RESOLUTION authorizing and ordering certain -street, sewer and sidewalk improvements, ordering.preparation of plans and.specifications, and the estimate of costs. - - WHEREAS, the public hearing on the advisability of.the following improve- ments, to wit: A. Streets to be paved are: (1) Marc Street from the south line of Albert to the north line of Fentwood Drive. (2) Lewis Avenue from.the south line of.Albert to the north line of Wayne Avenue. (3) Buckeye Avenue from the east line of Lewis to the west line of Ohio. (4) Shalimar Drive from the east line of Lewis to the west line of Ohio. (5)- Pentwood Drive from the east line of.Roach to the west line of Lewis. Sidewalks to be placed on eah side of the same streets to be paved and _ (1) the east side of Roach from Albert to Wayne (2) the North side of Warne from Roach to Ohio (3) the west side of Ohio from Albert to Wayne. (4) the.south side of Albert from Roach to Ohio Sanitary Sewers tobe built are: (1) 8 inch line in north and south easement in Block 1. (2) 8 inch line in north and south easement inBlock 2. (3). 8 inch line in east and west easement in Block 3. (4) 8 inch line in north and south easement in Block 4. (5) 8 inch line in north and south easement in Block 5. (6) 8 inch line innorth and south easement inBlock 6. was held as provided by Resolution Number 2180 adopted and approved by the Board of Commissioners of the City of Salina, Kansas, on the 23rd day of - June 1959. WHEREAS., notice of public hearing on the advisability of the said im- provements has been published in the Salina Journal, the official city gewsr pape on the 1st and 8th days of July 1959, as provided by said Resolution, and Section 4s. Chapter 99, Session Laws of 1957, State of Kansas. WHEREA&, the Board of Commissioners of the City of.Salina, Kansas, met in the Commissioners Room at the City Hall on the 14th day of July, 1959, a 4:00 o'clock P. M. for the purpose of conducting a public hearing on the advisability of said improvements, said hearings were „finally adjourned on the 14th day of July, 1959, all as provided by. law. WHEREAS, six (6) months have not elapsed since the final adjournment of said public hearing. NOW THEREFORE; BE IT RESOLVED BY THE BOARD OF COMMISSIONERS OF THE CITY OF SALINA, KANSAS.: m Section 1. A. That the following improvement be.and the same is hereby authorized and ordered to be made in accordance with the findings of the Board of Commiissioners of the City of Salina, Kansas, upon the advisa— bility of the improvements, to wit: M Streets to be paved are: (1) Marc Street from the south line of Albert to the north line of Pentwood Drive. (2) Lewis Avenue from the south line of Albert to the north line of Wayne Avenue. - (3) Buckeye Avenue from the east line of Lewis to the west 1 ine of Ohio. (4) Shalimar Drive from the east line of Lewis to the west line of Ohio. (5) Pentwood Drive from the east line of Roach Street to the west 1 ine of Lewis. Sidewalks to be placed on each side of the same streets to be paved (1) the east side of Roach from Albert to Wayne (2) the north side of Wayne from Roach to Ohio (3) the west side of Ohio from Albert to Wayne (4) ' the south' side of Albert from Roach to Ohio Sanitary sewers to be built are: (1) 8 inch line in north and southeasement in Block 1. (2) 8 inch line in north and south easement inBlock 2. (3) 8 inch line in east and.west easement in Block 3. (10 8 inch line in -north and south easement in Block 4. (5} 8 -inch line in north and south easement in Block 5- °(6) 8 inch line in north and south easement in Block 6. B. The estimAted or probable cost of -such improvements is $159,901.68 C. The extent or bound4ries of the proposed improvement district to be assessed is: That part of the City of Salina,Sal ine County, Kansas, described as follows; to wit:' All of Blocks 1, 2, 3, 4, 5 and,6 of Shalimar Plaza Addition described as follows: (1) Beginning at the east line of Roach and the south line of Albert Avenue. (2) thence east along the south line of Albert Avenue to the west line of Ohio Street. (3) thence south along the west line of Ohio Street to the north lineof Wayne Avenue. (11) thence west along the north line of Wayne Avenue to the east line of Roach Street. (5) thence nort along the east line of Roach Street to the point of beginning. 1 1 1 i 19 D. The apporti:nme* of cost.betwen the improvement district and the City at large is as follows: (a) City at large to pay for paving of intersections. (b) City at large to pay for all excavations to bring streets to grade. (c) City Vater Department to lay water main,. including all valves, hydrants and circulation valves. (d) City at large to pay for storm sewers and appurtenances. (e) City at large to pay for sidewalks in interseatiors . E. The method of assessment shall be: (a) Private property to pay for concrete paving except.inter- section of streets. (b) Private property to pay for excavation the thickness of the paving. (c) Private propert y to pay for all costs of sanitary sewers, including manholes, lampholes and stub -puts under pavement, (d) Private property to pay $1.50 per front foot for each lot or parcel for water main. (e) Private property to pay for stub -outs under pavement for water services. (f) Private property to pay for concrete sidewalks except that placed in the intersections of streets. (g) The method assessment shall be made on the square foot basis. The assessment against each lot, piece or parcel of land shall be made in direct proportion to its fraction of the total area of property deemed benefited. F. The assessments with accrued interest, shall be levied as a special tax upon the property included thereon concurrent with general propertbr taxes and shall be payable in twenty (20) equal annual installments. Secrion 2. That the City Engineer be,aad he is hereby directed'and ordered to prepare.plans and specifications, and estimate of the cost of said im- provements by the 4th day of August, 1959. Section 3. That the said improvements shall not be commenced if within twenty (20) days after publication of the Resolution, written protests by both fifty-one (51%) per centor more of the resident owners of record of property within the improvement district and the owners of record of more than one-half of the total area of ' such district, ace filed with the CityClerk.
