A RESOLUTION relating to the authorizing of non-compliance with the Rear Yard
Requirements of Ordinance Number 5549, for Lots 13 and 14 in Block 2 Holiday
Addition to the City of Salina, Saline County, Kansas, known as 417 S. Clark Stree
WHEREAS, Electrical Equipment Co., of Salina, Kansas did apply for a certain
building permit relating to the utilization of Lots 13 and 14 in Block 2 Holiday
Addition to the City of Salina, Saline County, Kansas, known as 417 S. Clark Stree
WHEREAS, the Building Inspector of the City of Salina, Kansas, did refuse to
grant said permit, for the reason that non-compliance with the Rear Yard Requiremen
of Ordinance Number 5549 of said City, and
WHEREAS, Electrical Equipment Co. did appeal from such refusal to the Board of
Zoning Appeals of the City of Salina, Kansas, and have a hearing relating thereto;
and
WHEREAS, said Board did order that a hearing be had on said appeal and did direct
that notice be duly published informing the public that said hearing would be
held; and
WHEREAS, said notice was duly published and no persons appeared to protest the
variance from the requisites of said Ordinance, and SO NOW THEREFORE
IBE IT RESOLVED by the Board of Commissioners of the City of Salina, Kansas:
That Electrical Equipment Co., should be and is hereby authorized to utilize the
rull area of the lots described as aforesaid for the purpose of constructing and...
installing thereon facilities for their use in their program to the extent that
the Rear Yard Requirements are waived on the above mentioned property, and that
such variance is hereby determined to not_.be contrary.ao the public -.interest and
that , substantial ..justice :will be done by :such .author.ized variance;. and that such
authorization is consistent with the intent and purposes of the Zoning Ordinance
of -the City of Salina, Kansas.
