RESOLUTION NUMBER 2592
A RESOLUTION relating to the authorizing of non-compliance with the Side Yard
Requirements of Ordinance Number 5549, for an addition to the Womens Dormitory,
fronting on 129 West Claflin Avenue, Campus of Kansas Wesleyan University in the
City of Salina, Saline County, Kansas.
WHEREAS, Kanaas Wesleyan University, of Salina, Kanaas did apply for a certain
building permit relating to the utilization of an addition to the Womens Dormitory
fronting on 129 West Claflin Avenue, Campus of Kansas Wesleyan University, 6f
Salina, Saline County, Kansas.
WHEREAS, the Building Inspector of the City of Salina, Kansas, did refuse to grant
said permit for the reason that non-compliance with the Side Yard Requite-ments of
Ordinance Number 5549 of said City, and
WHEREAS, Kansas Wesleyan University did appeal from such refusal to the Board of
Zoning Appeals of the City of Salina, Kansas, and have a hearing relating thereto;
and
WHEREAS, said Board did order that a hearing be had on said appeal and did direct
that notice be duly published informing the public that said hearing would be
held; and
WHEREAS, said notice was duly published and no persons appeared to protest the
variance from the requisites of said Ordinance, and SO NOW, THEREFORE
BE IT RESOLVED by the Board of Commissioners of the City of Salina, Kansas;
That Kansas Wesleyan University, should be and is hereby authorized to utilize
the full area of the lot described as aforesaid for the purpose of constructing
and installing thereof facilities for their use in their program to the extent
that the Side Yard Requirements are ilaived on the above mentioned property, and
that such variance is hereby determined to not be contrary to the public interest
and that substantial justice will be done by such authorized variance, and that
such authorization is consistent with the intent and purposes of the Zoning
Ordinances of the City of Salina, Kansas.
