2591 Improvements252 RESOLUTION NUMBER 2591 (Published in The Salina Journal , 1962) A RESOLUTION determining the advisability of certain street, sidewalks, sewer, water mains and hydrant improvements, estimating the cost thereof, defining the boundaries of the improvements district, method of assessment, and apportioning the cost between the improvement district and the City at large. WHEREAS, the public hearing on the advisability of the following improvements to -wit: 1. This improvement consists of the curbing, guttering and paving of: (a) Highland Avenue from the south line of Parkway to the north line of Cottonwood Road. (b) Ninth -Street Place from the south line of Parkway to the north line of Belmont Boulevard. (c) Simmons Street from the south line of Parkway to the north Tine of Roy Avenue. (d) Larson Street from the south line of Parkway to'the north line of Key Avenue. (e) Belmont Boulevard from the south line of Parkway to the east Tine of US 81 Highway. (f) Fourth Street from the south line of Parkway to the north line of Cottonwood Road. (g) Hartland Avenue from the east line of Larson to the west line of U. P. Railroad. (h) Roy Avenue from the east side of Highland to the north side of Cottonwood Road. (i) Key Avenue from the east line of Ninth Street Place to the north line of Cottonwood Road. (j) Morland Avenue from the east line of Highland to the south line of Key Avenue. (k) Dawn Street from the south line of Belmont Boulevard to the north line of Cottonwood Road. (1) Allen Street from the south line of Belmont Boulevard to the north line of Cottonwood Road. (m) Daley Stteet from the south line of Belmont Boulevard to the north line of Cottonwood Road. (n) Cottonwood Road from the east line of US 81 Highway to the west line of U. P. Railroad. 2. Water main to be installed in all the above described streets. 3. The sanitary sewer to serve all lots and parcels within the benefit district hereinafter described. 4. Sidewalks at all intersections and corner lots in each block of the benefit district. was held as provided by Resolution Number 2586 adopted and approved by the Board of Commissioners of the City of Salina, Kansas, on the 16th day of January 1962.. WHEREAS, notice of public hearing on the advisability of the said improvement, has been published in The Salina Journal, the official city newspaper, on the 24th day of. January 1962 and the 31st day of January 1962 as provided by said Resolutioi and G. S. 1959, Supp. Section 12-6a01 to 12-6a18, State of Kansas. 1 u 1 1 'J WHEREAS, the Board of Commissioners of the City of Salina, Kansas, met in the Commissioners Room at the City Hall on the 13th day of February 1962 at 4:00 �o'clokc P. M. for the purpose of conducting apublic hearing on the advisability of said improvements, said hearings were finally adjourned on the 13th day of February 1962 all as provided by law." NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF COMMISSIONERS OF THE CITY OF SALINA, KANSAS: Section 1. That the Board of Commissioners of the City of Salina, Kansas, hereby finds and finally determines that: A. It is advisable to make the following improvements, to -wit: 1. This improvement consists of the curbing, guttering and paving of: (a) Highland Avenue from the south line of Parkway to the north line of Cottonwood Road. (b) Ninth Street Place from the south line of Parkway to the north line of Belmont Boulevard. (c) Simmons Street from the south line of Parkway to the north Tine of Roy Avenue. (d) Larson Street from the south line of Parkway to the north line of Key Avenue. (e) Belmont Boulevard from the south line of Parkway to -the east line of US 81 Highway. (f) Fourth Street from the south line of Parkway to the north line of Cottonwood Road. (g) Hartland Avenue from the east line of Larson to the -west line of U. P. Railroad. (h) Roy Avenue from the east side of Highland to the north side of Cottonwood Road. (i) Key Avenue from the east`1ine of Ninth Street Place - to the north line of Cottonwood Road. (j) Morland Avenue from the east line of Highland to the south line of Key Avenue. - (k) Dawn Street from the south line of Belmont Boulevafd to the north line of Cottonwood Road: - (1) Allen Street from the south line of Belmont Boulevard to the north line of Cottonwood Road. (m) Daley Street from the south line of Belmont Boulevard to the north line of Cottonwood Road. (n) Cottonwood Road from the east line of US 81 Highway to the west line of U. P. Railroad. 2. Water main to be installed in all the above described streets. 3. The sanitary sewer to serve all lots and parcels within the benefit district hereinafter described. 4. Sidewalks at all intersections and corner lots in each block of the benefit district. B. The estimated or -probable cost of such improvements is $592,751.17. C. The extent or boundaries of the proposed improvement district to be ssessed is: That part of the City of Salina, Saline County, Kansas, described as follows -wit: 254 1. Beginning at a point which is the center line of Parkway Avenue ins: Key Acres Addition intersects the east right-of-way line of U. S. 81 Highway. 2. thence easterly along the center line of Parkway Avenue to the east line of Fourth Street. 3. thence south to the southwest corner of Lot 18, Block 29, Key Acres Addition. 4. thence east along the south line of said Lot 18 to the west line of Union Pacific Railroad right-of-way.: 5. thence south along said west right-of-way line of the Union Pacific Railroad to a point 200 feet south of the center line of Cottonwood Road. 6. thence west along a line 200 feet south and parallel to to the center line of Cottonwood Road to the east right-of-way line of U. S. 81 Highway. 7. thence north along the east right-of-way line of said U. S. S1 Highway to the point of beginning. D. The proposed apportionment of cost between the improvement district and the City at large is as follows: 1. Costs Chargeable to Private property: (1) All of sanitary sewers. (2) Stub outs under pavements for water and sanitary sewers. (3) Storm Sewer inlets which are contingent to pavement including connection pipes to manholes. (4) 90% of all other such pavements, grading, sidewalks and water mains that serve lots.` 2. Chargeable to City at Large: (1) Extra width of pavement in excess of 40 feet face to face. (2) Storm Sewers except (3) above. (3) Fire Hydrants. (4) Water circulation mains. (5) 1076 of all other such as pavements, grading, sidewalks and water mains that serve lots. E. The assessments with accrued interest shall be levied as a special tax upon the property included therein concurrent with the general property taxes and shall be payable in Twenty (20) equal annual installments. F. The method of assessment shall be made on the square foot basis, the assessment against each lot, piece or parcel of land shall be made in direct proportion to its fraction of the total area of property deemed benefited. Section 2. BE IT FURTHER RESOLVED that the public hearing on the advisability of the improvement set out in Section 1 hereof, is hereby finally adjourned.
