2588 Eminent Domainr] 1 RES I A RESOLUTION authorizing and directing the City Treasurer to Deposit with the Clerk of the District Court the sum of SeventeenThousand Six -Hundred Sixty-three and 92/100 Dollars ($17,663.92) in payment of damages assessed by the Commissione in case no. 23,505 now on file in the district court of Saline County, Kansas. WHEREAS, by Ordinance Number 6,583 the governing body duly condemned certain lands which are fully described in said ordinance and authorized and directed the City Attorney to file an application with the judges of the District Court of Saline County, Kansas, for the appointment of Commissioners to assess the damages arising from the apporpriation of said property; and, WHEREAS, on the 30th day of November 1961, the judges of the District Court of Saline County, Kansas, duly appointed N. C. Grant, Leonard Wood.and Dervidt L. McReynolds as.such Commissioners; and, WHEREAS on the 29th day of January, 1962 the above-mentioned Commissioners duly filed with the City Clerk and with the Clerk of the District Court of Saline County, Kansas, their report in which the said damages were determined to be in the sum of Seventeen -thousand six -hundred sixty-three and 92/100 Dollars ($17,663.92): and . WHEREAS, the City Clerk did on the 30th day of January 1962, prepare and transmit a copy of the said Commissioners' report to the governing body of the City of Salina, Kansas. NOW THEREFORE, BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF SALINA, KANSAS: Section 1. That the City Clerk be authorized and directed to certify a copy of said Commissioners' report and to deposit the same in the office of the City Treasurer of said City. Section 2. That the City Treasurer be and he is hereby authorized and directed to deposit with the City of the District Court of Saline County, Kansas the sum of Seventeen -thousand Six -hundred sixty-three and 92/100 Dollars ($17,663.92) for the benefit of the owners of the land and easements in land condemned for the use of the City of Salina, Kansas, for the sewage treatment -- plant improvements and sanitary trunk line extension. Section 3. That the City Treasurer, after payment of said amount to the lerk of the District Court, be further directed to certify said payment to. -the egister of Deeds of Saline County, Kansas.
